To amend the Robert T. Stafford Disaster Relief and Emer-
gency Assistance Act to ensure food assistance during
a major disaster or emergency declared under such Act.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Expanding Access to
4
Emergency Meals Act’’.
5
SEC. 2. EXCEPTION TO DUPLICATION OF BENEFITS.
6
Section 312(b) of the Robert T. Stafford Disaster Re-
7
lief and Emergency Assistance Act (42 U.S.C. 5155(b))
8
is amended by adding at the end the following:

‘‘(5) EXCEPTION TO PROHIBITION ON DUPLICA-

TION
OF
ASSISTANCE.—During the period of a
2
major disaster or emergency declared under this Act,
3
this section shall not prohibit the provision of Fed-
4
eral assistance under this Act to any person who is
5
or may be entitled to receive nutrition assistance
6
through a program administered by the Secretary of
7
Agriculture, and receipt of such assistance shall not
8
be considered duplicative assistance, except that a
9
person receiving benefits (as defined in section 3 of
10
the Food and Nutrition Act of 2008 (7 U.S.C.
11
2012)) under only section 5(h)(1) of the Food and
12
Nutrition Act of 2008 (7 U.S.C. 2014(h)(1)) may
13
not simultaneously receive food for distribution to
14
households authorized under section 413 of this Act
15
or be certified to receive benefits under section 5(a)
16
of the Food and Nutrition Act of 2008 (7 U.S.C.
17
2014(a)).’’.
