AN ACT
To amend the Robert T. Stafford Disaster Relief and Emer-
gency Assistance Act to provide flexibility with the cost
share for fire management assistance, and for other pur-
poses.

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Wildfire Recovery
2
Act’’.

SEC. 2. FIRE MANAGEMENT ASSISTANCE COST SHARE.

(a) IN GENERAL.—Section 420 of the Robert T.
5
Stafford Disaster Relief and Emergency Assistance Act is
6
amended—
7
(1) by redesignating subsection (e) as sub-
8
section (f); and
9
(2) by inserting after subsection (d) the fol-
10
lowing:

‘‘(e) FEDERAL SHARE.—The Federal share of assist-
12
ance under this section shall be not less than 75 percent
13
of the eligible cost of such assistance.’’.
14
(b) APPLICABILITY.—The amendment made by sub-
15
section (a) shall only apply to amounts appropriated on
16
or after the date of enactment of this Act.

SEC. 3. RULEMAKING.

Not later than 3 years after the date of enactment
19
of this Act, the President, acting through the Adminis-
20
trator of the Federal Emergency Management Agency,
21
shall conduct and complete a rulemaking to provide cri-
22
teria for the circumstances under which the Administrator
23
may recommend the President increase the Federal cost
24
share for section 420 of the Robert T. Stafford Disaster
25
Relief and Emergency Assistance Act (42 U.S.C. 5187).

Such criteria shall include a threshold metric that assesses
1
the financial impact to a State or local government from
2
responding to a fire for which fire management assistance
3
is being provided.
