EXCEPTION TO CERTAIN MANDATORY MINIMUM 1 SENTENCING REQUIREMENTS FOR PERSON 2 EMPLOYED OUTSIDE THE UNITED STATES BY 3 A FEDERAL AGENCY, WHO USES, CARRIES, OR 4 POSSESSES A FIREARM DURING AND IN RE- 5 LATION TO A CRIME OF VIOLENCE COM- 6 MITTED WHILE ON-DUTY WITH A FIREARM 7 REQUIRED TO BE CARRIED WHILE ON-DUTY. 8 Section 3261 of title 18, United States Code, is 9 amended by adding at the end the following: 10 ‘‘(e) Notwithstanding subsection (a) of this section, 11 if the offense is a violation of section 924(c)(1) of this 12 title, the minimum sentencing requirements of section 13 924(c)(1)(A) of this title shall not apply if— 14 ‘‘(1) the person committed a crime of violence 15 during and in relation to the offense; 16 ‘‘(2) an agency of the United States required 17 the person to carry a firearm while on-duty; and 18 ‘‘(3) at the time the person used, carried, or 19 possessed the firearm, the person was employed out- 20 side the United States by the agency, and was on- 21 duty.’’. 22 Æ VerDate Sep 11 2014 20:54 Mar 12, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H1105.IH H1105 pamtmann on DSKBC07HB2PROD with BILLS
