facility is not subject to requirements to prepare certain environmental
or historical preservation reviews.

Mr. JOYCE of Pennsylvania introduced the following bill; which was referred
to the Committee on Energy and Commerce, and in addition to the Com-
mittee on Natural Resources, for a period to be subsequently determined
by the Speaker, in each case for consideration of such provisions as fall
within the jurisdiction of the committee concerned
A BILL
To provide that a project for the collocation of a tele-
communications service facility is not subject to require-
ments to prepare certain environmental or historical
preservation reviews.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Broadband Competi-
4
tion and Efficient Deployment Act’’.

SEC. 2. APPLICATION OF NEPA AND NHPA TO COLLOCA-
1
TION OF TELECOMMUNICATIONS SERVICE

FACILITIES.
3
(a) NEPA EXEMPTION.—A covered project shall not
4
be subject to the requirements of section 102(2)(C) of the
5
National Environmental Policy Act of 1969 (42 U.S.C.
6
4332(2)(C)).
7
(b) NATIONAL HISTORIC PRESERVATION ACT EX-
8
EMPTION.—A covered project shall not be considered an
9
undertaking under section 300320 of title 54, United
10
States Code.

(c) DEFINITIONS.—In this section:
12
(1) COMMISSION.—The term ‘‘Commission’’
13
means the Federal Communications Commission.
14
(2) COVERED
PROJECT.—The term ‘‘covered
15
project’’ means a project—
16
(A) for the placement, construction, or
17
modification of a telecommunications service fa-
18
cility in or on eligible support infrastructure;
19
and
20
(B) for which a permit, license, or approval
21
from the Commission is required or that is oth-
22
erwise subject to the jurisdiction of the Com-
23
mission.

(3) ELIGIBLE
SUPPORT
INFRASTRUCTURE.—

The term ‘‘eligible support infrastructure’’ means in-

frastructure that supports or houses a facility for
1
communication by wire (or is designed to and capa-
2
ble of supporting or housing such a facility) at the
3
time when a complete request to a State or local
4
government or instrumentality thereof for authoriza-
5
tion to place, construct, or modify a telecommuni-
6
cations service facility in or on the infrastructure is
7
received by the government or instrumentality.

(4) STATE.—The term ‘‘State’’ means the 50
9
States, the District of Columbia, the territories and
10
possessions of the United States, and each federally
11
recognized Indian Tribe.

(5)
TELECOMMUNICATIONS
SERVICE.—The
13
term ‘‘telecommunications service’’ has the meaning
14
given such term in section 3 of the Communications
15
Act of 1934 (47 U.S.C. 153).

(6) TELECOMMUNICATIONS
SERVICE
FACIL-
17
ITY.—The
term
‘‘telecommunications
service
18
facility’’means a facility for the provision of any
19
interstate or intrastate telecommunications service.
