To amend title XVIII of the Social Security Act to provide for the automatic
qualification of certain Medicaid beneficiaries for premium and cost-
sharing subsidies under part D of the Medicare program, and for other
purposes.

Mr. PAPPAS (for himself and Mr. TONKO) introduced the following bill; which
was referred to the Committee on Energy and Commerce, and in addition
to the Committee on Ways and Means, for a period to be subsequently
determined by the Speaker, in each case for consideration of such provi-
sions as fall within the jurisdiction of the committee concerned
A BILL
To amend title XVIII of the Social Security Act to provide
for the automatic qualification of certain Medicaid bene-
ficiaries for premium and cost-sharing subsidies under
part D of the Medicare program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Advancing Enrollment
4
and Reducing Drug Costs Act of 2021’’.

SEC. 2. AUTOMATIC QUALIFICATION OF CERTAIN MED-
1
ICAID BENEFICIARIES FOR PREMIUM AND
2
COST-SHARING SUBSIDIES UNDER PART D OF
3
THE MEDICARE PROGRAM.
4
(a) IN GENERAL.—Clause (v) of section 1860D–
5
14(a)(3)(B) of the Social Security Act (42 U.S.C. 1395w–
6
114(a)(3)(B)) is amended—
7
(1) in subclause (I), by striking ‘‘and’’ at the
8
end;
9
(2) in subclause (II), by striking the period and
10
inserting ‘‘; and’’; and
11
(3) by inserting after subclause (II) the fol-
12
lowing new subclause:
13
‘‘(III) shall, notwithstanding the
14
preceding clauses of this subpara-
15
graph, provide that any part D eligi-
16
ble individual not described in sub-
17
clause (I) or (II) who is enrolled, as
18
of the day before the date on which
19
such individual attains the age of 65,
20
for medical assistance under a State
21
plan under title XIX (or a waiver of
22
such
plan)
pursuant
to
clause
23
(i)(VIII)
or
(ii)(XX)
of
section
24
1902(a)(10)(A), and who has income
25
below 200 percent of the poverty line

applicable to a family of the size in-

volved, shall be treated as a subsidy
2
eligible individual described in para-
3
graph (1) for a limited period of time,
4
as specified by the Secretary.’’.

(b) EFFECTIVE DATE.—The amendments made by
6
subsection (a) shall apply with respect to plan years begin-
7
ning on or after January 1, 2022.
