Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Restoring and Enforc- 4 ing Accountability of Presidents Act’’ or the ‘‘REAP Act’’. 5 SEC. 2. FORFEITURE OF BENEFITS FOR FORMER PRESI- 6 DENTS CONVICTED OF A FELONY. 7 The Act entitled ‘‘An Act to provide retirement, cler- 8 ical assistants, and free mailing privileges to former Presi- 9 dents of the United States, and for other purposes’’, ap- 10 VerDate Sep 11 2014 16:45 Mar 13, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1153.IH H1153 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 1153 IH proved August 25, 1958 (commonly known as the 1 ‘‘Former Presidents Act of 1958’’; 3 U.S.C. 102 note), 2 is amended— 3 (1) in subsection (a), by striking ‘‘Each former 4 President’’ and inserting ‘‘Subject to subsection (h), 5 each former President’’; 6 (2) in subsection (f), by striking paragraph (2) 7 and inserting: 8 ‘‘(2) who has not been impeached by the House 9 of Representatives and convicted by the Senate pur- 10 suant to the impeachment.’’; and 11 (3) by adding at the end the following new sub- 12 section: 13 ‘‘(h)(1) If a former President is finally convicted of 14 a felony for which every act or omission that is needed 15 to satisfy the elements of the felony is committed during 16 or after the period such former President holds the office 17 of President of the United States of America, or was fi- 18 nally convicted of such a felony while holding such office— 19 ‘‘(A) no monetary allowance under subsection 20 (a) may be provided to such former President; 21 ‘‘(B) no funds may be obligated or expended 22 under subsection (g) with respect to such former 23 President except to the extent necessary to maintain 24 VerDate Sep 11 2014 16:45 Mar 13, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1153.IH H1153 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 1153 IH the security of such former President, as determined 1 by the Director of the Secret Service; and 2 ‘‘(C) such former President shall repay any 3 amounts received under subsection (a) during the 4 period beginning on the date on which such former 5 President is initially convicted of the felony and end- 6 ing on the date such former President is finally con- 7 victed of the felony. 8 ‘‘(2) The term ‘finally convicted’ means a convic- 9 tion— 10 ‘‘(A) which has not been appealed and is no 11 longer appealable because the time for taking an ap- 12 peal has expired; or 13 ‘‘(B) which has been appealed and the appeals 14 process for which is completed.’’. 15 Æ VerDate Sep 11 2014 16:45 Mar 13, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H1153.IH H1153 pamtmann on DSKBC07HB2PROD with BILLS
