tions facility entirely within a brownfield site is not subject to require-
ments to prepare certain environmental or historical preservation reviews.

Mr. WALBERG introduced the following bill; which was referred to the Com-
mittee on Energy and Commerce, and in addition to the Committee on
Natural Resources, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall within
the jurisdiction of the committee concerned
A BILL
To provide that a project for the deployment or modification
of a communications facility entirely within a brownfield
site is not subject to requirements to prepare certain
environmental or historical preservation reviews.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Brownfields Broad-
4
band Deployment Act’’.

SEC. 2. APPLICATION OF NEPA AND NHPA TO BROWN-

FIELDS.

(a) NEPA EXEMPTION.—A covered project shall not
3
be subject to the requirements of section 102(2)(C) of the
4
National Environmental Policy Act of 1969 (42 U.S.C.
5
4332(2)(C)).
6
(b) NATIONAL HISTORIC PRESERVATION ACT EX-
7
EMPTION.—A covered project shall not be considered an
8
undertaking under section 300320 of title 54, United
9
States Code.

(c) DEFINITIONS.—In this section:
11
(1) COMMISSION.—The term ‘‘Commission’’
12
means the Federal Communications Commission.
13
(2) COMMUNICATIONS
FACILITY.—The term
14
‘‘communications facility’’ includes—
15
(A) any wireless or wireline infrastructure
16
for the transmission of writing, signs, signals,
17
data, images, pictures, or sounds of all kinds;
18
(B) any transmitting device, tower, or sup-
19
port structure, and any equipment, switches,
20
wiring, cabling, power sources, shelters, or cabi-
21
nets, associated with the provision of commu-
22
nications service; and
23
(C) any antenna or apparatus that—
24
(i) is designed for the purpose of
25
emitting radio frequency;

(ii) is designed to be operated, or is
1
operating, from a fixed location; and
2
(iii) is added to a tower, building, or
3
other structure.

(3) COMMUNICATIONS
SERVICE.—The term
5
‘‘communications service’’ means a service for the
6
transmission of writing, signs, signals, data, images,
7
pictures, or sounds of all kinds.
8
(4) COVERED
PROJECT.—The term ‘‘covered
9
project’’ means a project—
10
(A) for the deployment or modification of
11
a communications facility that is to be carried
12
out entirely within a brownfield site (as defined
13
in section 101 of the Comprehensive Environ-
14
mental Response, Compensation, and Liability
15
Act of 1980 (42 U.S.C. 9601)); and
16
(B) for which a permit, license, or approval
17
from the Commission is required or that is oth-
18
erwise subject to the jurisdiction of the Com-
19
mission.
