A BILL
To amend the Help America Vote Act of 2002 to prohibit
States from using a voting system which is connected
to the Internet in the administration of an election for
Federal office.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Election Technology
4
Integrity and Fraud Prevention Act’’.

SEC. 2. PROHIBITING CONNECTION OF VOTING SYSTEMS

TO INTERNET.

(a) PROHIBITION.—Section 301(a) of the Help Amer-
3
ica Vote Act of 2002 (52 U.S.C. 21081(a)) is amended
4
by adding at the end the following new paragraph:
5
‘‘(7) PROHIBITING CONNECTION OF SYSTEM TO
6
THE INTERNET.—

‘‘(A) IN GENERAL.—No system or device
8
upon which ballots are programmed or votes are
9
cast or tabulated shall be connected to the
10
Internet at any time.
11
‘‘(B) PROHIBITING ACCEPTANCE OF BAL-
12
LOTS TRANSMITTED ONLINE.—The voting sys-
13
tem may not directly tabulate any voted ballot
14
which is transmitted to an election official on-
15
line.

‘‘(C) RULE OF CONSTRUCTION.—Nothing
17
contained in this paragraph shall be deemed to
18
prohibit the Commission from conducting the
19
studies under section 242 or to conduct other
20
similar studies under any other provision of law
21
in a manner consistent with this paragraph.’’.

(b) EFFECTIVE DATE.—Section 301(d) of such Act
23
(52 U.S.C. 21081(d)) is amended by striking the period
24
at the end and inserting the following: ‘‘, or, in the case

of the requirements of paragraph (7) of subsection (a),
