A BILL
To protect the right of individuals to bear arms at water
resources development projects administered by the Sec-
retary of the Army, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Recreational Lands
4
Self-Defense Act of 2021’’.
5
SEC. 2. PROTECTING AMERICANS FROM VIOLENT CRIME.

(a) FINDINGS.—Congress finds the following:

(1) The Second Amendment to the Constitution
1
provides that ‘‘the right of the people to keep and
2
bear Arms, shall not be infringed’’.
3
(2) Section 327.13 of title 36, Code of Federal
4
Regulations, provides that, except in special cir-
5
cumstances, ‘‘possession of loaded firearms, ammu-
6
nition, loaded projectile firing devices, bows and ar-
7
rows, crossbows, or other weapons is prohibited’’ at
8
water resources development projects administered
9
by the Secretary of the Army.

(3) The regulations described in paragraph (2)
11
prevent individuals complying with Federal and
12
State laws from exercising the Second Amendment
13
rights of the individuals while at such water re-
14
sources development projects.
15
(4) The Federal laws should make it clear that
16
the Second Amendment rights of an individual at a
17
water resources development project should not be
18
infringed.

(b) PROTECTING THE RIGHT OF INDIVIDUALS TO
20
BEAR ARMS
AT WATER RESOURCES DEVELOPMENT

PROJECTS.—The Secretary of the Army shall not promul-
22
gate or enforce any regulation that prohibits an individual
23
from possessing a firearm, including an assembled, func-
24
tional, or loaded firearm, at a water resources development

project covered under section 327.0 of title 36, Code of
1
Federal Regulations (as in effect on the date of enactment
2
of this Act), if—
3
(1) the individual is not otherwise prohibited by
4
law from possessing the firearm; and
5
(2) the possession of the firearm is in compli-
6
ance with the law of the State in which the water
7
resources development project is located.
