TEMPORARY INCREASE IN FMAP FOR MEDICAL AS- 1 SISTANCE UNDER STATE MEDICAID PLANS 2 WHICH BEGIN TO EXPEND AMOUNTS FOR 3 NEWLY ELIGIBLE MANDATORY INDIVIDUALS. 4 Section 1905 of the Social Security Act (42 U.S.C. 5 1396d) is amended— 6 (1) in subsection (b), in the first sentence, by 7 striking ‘‘and (ff)’’ and inserting ‘‘(ff), and (hh)’’; 8 and 9 (2) by adding at the end the following new sub- 10 section: 11 ‘‘(hh) TEMPORARY INCREASE IN FMAP FOR MED- 12 ICAL ASSISTANCE UNDER STATE MEDICAID PLANS 13 WHICH BEGIN TO EXPEND AMOUNTS FOR ALL NEWLY 14 ELIGIBLE MANDATORY INDIVIDUALS.— 15 ‘‘(1) IN GENERAL.—Subject to paragraph (2), 16 for the 8-quarter period beginning with the first cal- 17 endar quarter during which a qualifying State (as 18 defined in paragraph (4)) expends amounts for all 19 newly eligible individuals described in section 20 1902(a)(10)(A)(i)(VIII) under the State plan (or 21 waiver of such plan), the Federal medical assistance 22 percentage determined under subsection (b) for such 23 State shall be increased by 5 percentage points. 24 ‘‘(2) EXCEPTION.—In the case of a State that 25 ceases to provide medical assistance to any newly eli- 26 VerDate Sep 11 2014 23:45 Feb 25, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H871.IH H871 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 871 IH gible individual under the State plan (or waiver of 1 such plan) during a quarter occurring during the pe- 2 riod described in paragraph (1), the increase de- 3 scribed in such paragraph shall not apply with re- 4 spect to such State and such quarter (or any suc- 5 ceeding quarter). 6 ‘‘(3) SPECIAL APPLICATION RULES.—Any in- 7 crease described in paragraph (1)— 8 ‘‘(A) shall not apply with respect to dis- 9 proportionate share hospital payments described 10 in section 1923; 11 ‘‘(B) shall not be taken into account in cal- 12 culating the enhanced FMAP of a State under 13 section 2105; and 14 ‘‘(C) shall not be taken into account for 15 purposes of part A, D, or E of title IV. 16 ‘‘(4) DEFINITION.—For purposes of this sub- 17 section, the term ‘qualifying State’ means a State 18 which has not expended amounts for all newly eligi- 19 ble individuals described in section 20 1902(a)(10)(A)(i)(VIII) before the date of the enact- 21 ment of this subsection.’’. 22 Æ VerDate Sep 11 2014 23:45 Feb 25, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H871.IH H871 pamtmann on DSKBC07HB2PROD with BILLS
