To amend the Richard B. Russell National School Lunch
Act to improve the efficiency of summer meals.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Summer Meals Act
4
of 2021’’.
5
SEC. 2. SUMMER FOOD SERVICE PROGRAM FOR CHILDREN.

(a) BETTER INTEGRATE SUMMER EDUCATION AND
7
SUMMER MEALS PROGRAM.—Section 13(a)(1)(A)(i) of
8
the Richard B. Russell National School Lunch Act (42

U.S.C. 1761(a)(1)(A)(i)) is amended by striking ‘‘50 per-

cent’’ each place it appears and inserting ‘‘40 percent’’.

(b) REDUCE RED TAPE FOR PUBLIC-PRIVATE PART-
3
NERSHIPS.—Section 13(a) of the Richard B. Russell Na-
4
tional School Lunch Act (42 U.S.C. 1761(a)) is amended
5
by striking paragraph (8) and inserting the following:
6
‘‘(8) YEAR-ROUND MEAL SERVICE.—
7
‘‘(A) SEAMLESS
SUMMER
OPTION
FOR
8
SCHOOLS.—Except as otherwise determined by
9
the Secretary, a service institution that is a
10
public or private nonprofit school food authority
11
may provide summer or school vacation food
12
service in accordance with applicable provisions
13
of law governing the school lunch program es-
14
tablished under this Act or the school breakfast
15
program established under the Child Nutrition
16
Act of 1966 (42 U.S.C. 1771 et seq.).

‘‘(B) YEAR-ROUND
MEAL
SERVICE
FOR
18
OTHER SERVICE INSTITUTIONS.—Each service
19
institution (other than a service institution de-
20
scribed in subparagraph (A)), in addition to
21
being eligible for reimbursement for meals de-
22
scribed in subsection (b)(2) served during each
23
day of operation during the periods described in
24
subsection (c)(1), may be reimbursed for up to

1 meal and 1 snack per child served during
1
each day of operation during—
2
‘‘(i) afterschool hours;
3
‘‘(ii) weekends; and
4
‘‘(iii) school holidays during the reg-
5
ular school calendar.’’.

(c) IMPROVE NUTRITION IN UNDERSERVED, HARD-
7
TO-REACH AREAS.—Section 13(a) of the Richard B. Rus-
8
sell National School Lunch Act (42 U.S.C. 1761(a)) is
9
amended—
10
(1) by striking paragraphs (9) and (10) and in-
11
serting the following:
12
‘‘(9) IMPROVE
NUTRITION
IN
UNDERSERVED,
13
HARD-TO-REACH AREAS.—
14
‘‘(A) IN GENERAL.—Subject to the avail-
15
ability of appropriations provided in advance in
16
an appropriations Act specifically for the pur-
17
pose of carrying out this paragraph, the Sec-
18
retary may award competitive grants to service
19
institutions selected by the Secretary to in-
20
crease participation in the program at con-
21
gregate feeding sites through—
22
‘‘(i) innovative approaches to limited
23
transportation; and
24
‘‘(ii) mobile meal trucks.

‘‘(B) ELIGIBILITY.—To be selected to re-
1
ceive a grant under this paragraph, a service in-
2
stitution—
3
‘‘(i) may be located in any State; and
4
‘‘(ii) shall—
5
‘‘(I) submit to the Secretary an
6
application at such time, in such man-
7
ner, and containing such information
8
as the Secretary may require;
9
‘‘(II) meet criteria established by
10
the Secretary; and
11
‘‘(III) agree to the terms and
12
conditions of the grant, as established
13
by the Secretary.
14
‘‘(C)
PRIORITY.—In
awarding
grants
15
under this paragraph, the Secretary shall give
16
priority to service institutions that—
17
‘‘(i) serve both breakfast and lunch;
18
or
19
‘‘(ii) offer educational or enrichment
20
programs.
21
‘‘(D) TRAVEL REIMBURSEMENT.—A serv-
22
ice institution that receives a grant under sub-
23
paragraph (A)(i) may use grant funds to pro-

vide reimbursement for travel to satellite con-

gregate feeding sites.

‘‘(E)
AUTHORIZATION
OF
APPROPRIA-
3
TIONS.—There is authorized to be appropriated
4
to the Secretary to make competitive grants
5
under this paragraph $10,000,000 for each fis-
6
cal year.’’; and
7
(2) by redesignating paragraphs (11) and (12)
8
as paragraphs (10) and (11), respectively.

(d) THIRD MEAL.—Section 13(b)(2) of the Richard
10
B. Russell National School Lunch Act (42 U.S.C.
11
1761(b)(2)) is amended by striking ‘‘only serve lunch’’
12
and all that follows through ‘‘migrant children may’’.
