A BILL
To amend the Social Security Act to require a certification
that States and units of local governments will not im-
pact the operations of a small business concern to receive
funds from the Coronavirus Relief Fund, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Right to Earn a Living
4
Act of 2021’’.

CERTIFICATION
TO
RECEIVE
FUNDS
FROM
1
CORONAVIRUS RELIEF FUND.

Section 601 of the Social Security Act (42 U.S.C.
3
801) is amended—
4
(1) by redesignating subsections (f) and (g) as
5
subsections (g) and (h), respectively;
6
(2) by inserting after subsection (e) the fol-
7
lowing new subsection:

‘‘(f) CERTIFICATION REQUIREMENT TO KEEP SMALL
9
BUSINESS CONCERNS OPEN.—
10
‘‘(1) IN GENERAL.—In order to receive a pay-
11
ment under this section, a State or unit of local gov-
12
ernment shall provide the Secretary with a certifi-
13
cation signed by the Chief Executive of such State
14
or unit of local government that such Chief Execu-
15
tive shall not implement an order, without legislative
16
action by the State or unit of local government,
17
that—
18
‘‘(A) prevents a small business concern
19
from operating; or
20
‘‘(B) places limitations on the hours or oc-
21
cupancy of a small business concern.
22
‘‘(2) APPLICABILITY.—The certification re-
23
quired under paragraph (1) shall apply to any re-
24
ceipt of funds after the date of the enactment of the
25
‘Right to Earn a Living Act of 2021’.’’; and
