Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. DEFINITION OF ADMINISTRATOR. 1 In this Act, the term ‘‘Administrator’’ means the Ad- 2 ministrator of the Environmental Protection Agency. 3 SEC. 3. LIFECYCLE GREENHOUSE GAS EMISSIONS FROM 4 CORN-BASED ETHANOL AND BIODIESEL. 5 (a) IN GENERAL.—Subject to subsection (b), not 6 later than 90 days after the date of enactment of this Act, 7 and every 5 years thereafter, the Administrator shall up- 8 date the methodology used by the Environmental Protec- 9 tion Agency in lifecycle analyses with respect to green- 10 house gas emissions that result from corn-based ethanol 11 and biodiesel. 12 (b) REQUIREMENTS.— 13 (1) FIRST UPDATE.—In carrying out the first 14 update required under subsection (a), the Adminis- 15 trator shall adopt the most recent Greenhouse gases, 16 Regulated Emissions, and Energy use in Transpor- 17 tation model (commonly referred to as the ‘‘GREET 18 model’’) developed by Argonne National Laboratory. 19 (2) SUBSEQUENT UPDATES.—In carrying out 20 the second and each subsequent update required 21 under subsection (a), the Administrator shall— 22 (A) as necessary, adopt, review, or update 23 a methodology determined to be appropriate by 24 the Administrator; or 25 VerDate Sep 11 2014 22:47 Feb 17, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S193.IS S193 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 193 IS (B) adopt the methodology described in 1 paragraph (1). 2 (c) REPORT.—If the Administrator fails to carry out 3 subsection (b)(2) before the applicable deadline described 4 in subsection (a), the Administrator shall submit to the 5 Committees on Agriculture, Nutrition, and Forestry, En- 6 ergy and Natural Resources, and Environment and Public 7 Works of the Senate and the Committees on Agriculture, 8 Energy and Commerce, and Science, Space, and Tech- 9 nology of the House of Representatives a report describing 10 the reasons for the failure to carry out subsection (b)(2), 11 which may include a determination by the Administrator 12 that the methodology adopted or updated in a previous 13 update under subsection (a) remains the most current 14 methodology based on available data, research, and tech- 15 nology. 16 Æ VerDate Sep 11 2014 22:47 Feb 17, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S193.IS S193 pbinns on DSKJLVW7X2PROD with BILLS
