SHORT TITLE. 1 This Act may be cited as the ‘‘Drug-Free Commu- 2 nities Pandemic Relief Act’’. 3 SEC. 2. WAIVER OF FEDERAL FUND LIMITATION FOR THE 4 DRUG-FREE COMMUNITIES SUPPORT PRO- 5 GRAM. 6 (a) IN GENERAL.—Subject to subsection (b), if the 7 Administrator of the Drug-Free Communities Support 8 Program determines that, as a result of the public health 9 emergency declared pursuant to section 319 of the Public 10 Health Service Act (42 U.S.C. 247d) as a result of 11 COVID–19, an eligible coalition is unable to raise the 12 amount of non-Federal funds, including in-kind contribu- 13 tions, agreed to be raised by the coalition for a fiscal year 14 under an agreement entered into with the Administrator 15 pursuant to paragraph (1)(A) or (3) of section 1032(b) 16 of the Anti-Drug Abuse Act of 1988 (21 U.S.C. 1532(b)), 17 the Administrator may, notwithstanding such paragraphs, 18 provide to the eligible coalition the grant or renewal grant, 19 as applicable, for that fiscal year in an amount— 20 (1) with respect to an initial grant or renewal 21 grant described under paragraph (1)(A) or (3)(A) of 22 such section, that exceeds the amount of non-Fed- 23 eral funds raised by the eligible coalition, including 24 in-kind contributions, for that fiscal year; 25 VerDate Sep 11 2014 23:01 Oct 21, 2021 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H654.RFS H654 kjohnson on DSK79L0C42PROD with BILLS 3 HR 654 RFS (2) with respect to a renewal grant described 1 under paragraph (3)(D)(i) of such section, that ex- 2 ceeds 125 percent of the amount of non-Federal 3 funds raised by the eligible coalition, including in- 4 kind contributions, for that fiscal year; and 5 (3) with respect to a renewal grant described 6 under paragraph (3)(D)(ii) of such section, that ex- 7 ceeds 150 percent of the amount of non-Federal 8 funds raised by the eligible coalition, including in- 9 kind contributions, for that fiscal year. 10 (b) LIMITATION.—The Administrator may not pro- 11 vide a grant or renewal grant to an eligible coalition in 12 an amount exceeding the amount of funds initially agreed 13 to be provided by the Administrator under the applicable 14 agreement. 15 SEC. 3. RAISING CAP ON ADMINISTRATIVE EXPENSES 16 UNDER ANTI-DRUG ABUSE ACT OF 1988. 17 Section 1024(b) of the Anti-Drug Abuse Act of 1988 18 (21 U.S.C. 1524(b)) is amended by striking ‘‘8 percent’’ 19 and inserting ‘‘12 percent’’. 20 Passed the House of Representatives October 20, 2021.
