Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Bronzeville-Black Me- 4 tropolis National Heritage Area Act’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) HERITAGE AREA.—The term ‘‘Heritage 8 Area’’ means the Bronzeville-Black Metropolis Na- 9 tional Heritage Area established by section 3(a). 10 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 670 IH (2) LOCAL COORDINATING ENTITY.—The term 1 ‘‘local coordinating entity’’ means the local coordi- 2 nating entity for the Heritage Area designated by 3 section 4(a). 4 (3) MANAGEMENT PLAN.—The term ‘‘manage- 5 ment plan’’ means the plan developed by the local 6 coordinating entity under section 5(a). 7 (4) SECRETARY.—The term ‘‘Secretary’’ means 8 the Secretary of the Interior. 9 (5) STATE.—The term ‘‘State’’ means the State 10 of Illinois. 11 SEC. 3. BRONZEVILLE-BLACK METROPOLIS NATIONAL HER- 12 ITAGE AREA. 13 (a) ESTABLISHMENT.—There is established the 14 Bronzeville-Black Metropolis National Heritage Area in 15 the State. 16 (b) BOUNDARIES.—The Heritage Area shall consist 17 of the region in the city of Chicago, Illinois, bounded as 18 follows: 19 (1) 18th Street on the North to 22nd Street on 20 the South, from Lake Michigan on the East to 21 Wentworth Avenue on the West. 22 (2) 22nd Street on the North to 35th Street on 23 the South, from Lake Michigan on the East to the 24 Dan Ryan Expressway on the West. 25 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 670 IH (3) 35th Street on the North to 47th Street on 1 the South, from Lake Michigan on the East to the 2 B&O Railroad (Stewart Avenue) on the West. 3 (4) 47th Street on the North to 55th Street on 4 the South, from Cottage Grove Avenue on the East 5 to the Dan Ryan Expressway on the West. 6 (5) 55th Street on the North to 67th Street on 7 the South, from State Street on the West to Cottage 8 Grove Avenue/South Chicago Avenue on the East. 9 (6) 67th Street on the North to 71st Street on 10 the South, from Cottage Grove Avenue/South Chi- 11 cago Avenue on the West to the Metra Railroad 12 tracks on the East. 13 SEC. 4. DESIGNATION OF LOCAL COORDINATING ENTITY. 14 (a) LOCAL COORDINATING ENTITY.—The Black Me- 15 tropolis National Heritage Area Commission shall be the 16 local coordinating entity for the Heritage Area. 17 (b) AUTHORITIES OF LOCAL COORDINATING ENTI- 18 TY.—The local coordinating entity may, for purposes of 19 preparing and implementing the management plan, use 20 Federal funds made available under this Act— 21 (1) to prepare reports, studies, interpretive ex- 22 hibits and programs, historic preservation projects, 23 and other activities recommended in the manage- 24 ment plan for the Heritage Area; 25 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 670 IH (2) to make grants to the State, political sub- 1 divisions of the State, nonprofit organizations, and 2 other persons; 3 (3) to enter into cooperative agreements with 4 the State, political subdivisions of the State, non- 5 profit organizations, and other organizations; 6 (4) to hire and compensate staff; 7 (5) to obtain funds or services from any source, 8 including funds and services provided under any 9 other Federal program or law; and 10 (6) to contract for goods and services. 11 (c) DUTIES OF LOCAL COORDINATING ENTITY.—To 12 further the purposes of the Heritage Area, the local co- 13 ordinating entity shall— 14 (1) prepare a management plan for the Herit- 15 age Area in accordance with section 5; 16 (2) give priority to the implementation of ac- 17 tions, goals, and strategies set forth in the manage- 18 ment plan, including assisting units of government 19 and other persons in— 20 (A) carrying out programs and projects 21 that recognize and protect important resource 22 values in the Heritage Area; 23 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 670 IH (B) encouraging economic viability in the 1 Heritage Area in accordance with the goals of 2 the management plan; 3 (C) establishing and maintaining interpre- 4 tive exhibits in the Heritage Area; 5 (D) developing heritage-based recreational 6 and educational opportunities for residents and 7 visitors in the Heritage Area; 8 (E) increasing public awareness of and ap- 9 preciation for the natural, historic, and cultural 10 resources of the Heritage Area; 11 (F) restoring historic buildings that are— 12 (i) located in the Heritage Area; and 13 (ii) related to the themes of the Herit- 14 age Area; and 15 (G) installing throughout the Heritage 16 Area clear, consistent, and appropriate signs 17 identifying public access points and sites of in- 18 terest; 19 (3) consider the interests of diverse units of 20 government, businesses, tourism officials, private 21 property owners, and nonprofit groups within the 22 Heritage Area in developing and implementing the 23 management plan; 24 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 6 •HR 670 IH (4) conduct public meetings at least semiannu- 1 ally regarding the development and implementation 2 of the management plan; and 3 (5) for any fiscal year for which Federal funds 4 are received under this Act— 5 (A) submit to the Secretary an annual re- 6 port that describes— 7 (i) the accomplishments of the local 8 coordinating entity; 9 (ii) the expenses and income of the 10 local coordinating entity; and 11 (iii) the entities to which the local co- 12 ordinating entity made any grants; 13 (B) make available for audit all records re- 14 lating to the expenditure of the Federal funds 15 and any matching funds; and 16 (C) require, with respect to all agreements 17 authorizing the expenditure of Federal funds by 18 other organizations, that the receiving organiza- 19 tions make available for audit all records relat- 20 ing to the expenditure of the Federal funds. 21 SEC. 5. MANAGEMENT PLAN. 22 (a) IN GENERAL.—Not later than 3 years after the 23 date on which funds are first made available to carry out 24 this Act, the local coordinating entity shall prepare and 25 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 7 •HR 670 IH submit to the Secretary a management plan for the Herit- 1 age Area. 2 (b) CONTENTS.—The management plan for the Her- 3 itage Area shall— 4 (1) include comprehensive policies, strategies, 5 and recommendations for the conservation, funding, 6 management, and development of the Heritage Area; 7 (2) take into consideration existing State and 8 local plans; 9 (3) specify the existing and potential sources of 10 funding to protect, manage, and develop the Herit- 11 age Area; 12 (4) include an inventory of the natural, historic, 13 cultural, educational, scenic, and recreational re- 14 sources of the Heritage Area relating to the themes 15 of the Heritage Area that should be preserved, re- 16 stored, managed, developed, or maintained; and 17 (5) include an analysis of, and recommenda- 18 tions for, ways in which Federal, State, and local 19 programs, may best be coordinated to further the 20 purposes of this Act, including recommendations for 21 the role of the National Park Service in the Heritage 22 Area. 23 (c) DISQUALIFICATION FROM FUNDING.—If a pro- 24 posed management plan is not submitted to the Secretary 25 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 8 •HR 670 IH by the date that is 3 years after the date on which funds 1 are first made available to carry out this Act, the local 2 coordinating entity may not receive additional funding 3 under this Act until the date on which the Secretary re- 4 ceives the proposed management plan. 5 (d) APPROVAL AND DISAPPROVAL OF MANAGEMENT 6 PLAN.— 7 (1) IN GENERAL.—Not later than 180 days 8 after the date on which the local coordinating entity 9 submits the management plan to the Secretary, the 10 Secretary shall approve or disapprove the proposed 11 management plan. 12 (2) CONSIDERATIONS.—In determining whether 13 to approve or disapprove the management plan, the 14 Secretary shall consider whether— 15 (A) the local coordinating entity is rep- 16 resentative of the diverse interests of the Herit- 17 age Area, including governments, natural and 18 historic resource protection organizations, edu- 19 cational institutions, businesses, and rec- 20 reational organizations; 21 (B) the local coordinating entity has pro- 22 vided adequate opportunities (including public 23 meetings) for public and governmental involve- 24 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 9 •HR 670 IH ment in the preparation of the management 1 plan; 2 (C) the resource protection and interpreta- 3 tion strategies contained in the management 4 plan, if implemented, would adequately protect 5 the natural, historic, and cultural resources of 6 the Heritage Area; and 7 (D) the management plan is supported by 8 the appropriate State and local officials, the co- 9 operation of which is needed to ensure the ef- 10 fective implementation of the State and local 11 aspects of the management plan. 12 (3) DISAPPROVAL AND REVISIONS.— 13 (A) IN GENERAL.—If the Secretary dis- 14 approves a proposed management plan, the Sec- 15 retary shall— 16 (i) advise the local coordinating entity, 17 in writing, of the reasons for the dis- 18 approval; and 19 (ii) make recommendations for revi- 20 sion of the proposed management plan. 21 (B) APPROVAL OR DISAPPROVAL.—The 22 Secretary shall approve or disapprove a revised 23 management plan not later than 180 days after 24 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 10 •HR 670 IH the date on which the revised management plan 1 is submitted. 2 (e) APPROVAL OF AMENDMENTS.— 3 (1) IN GENERAL.—The Secretary shall review 4 and approve or disapprove substantial amendments 5 to the management plan in accordance with sub- 6 section (d). 7 (2) FUNDING.—Funds appropriated under this 8 Act may not be expended to implement any changes 9 made by an amendment to the management plan 10 until the Secretary approves the amendment. 11 SEC. 6. RELATIONSHIP TO OTHER FEDERAL AGENCIES. 12 (a) IN GENERAL.—Nothing in this Act affects the au- 13 thority of a Federal agency to provide technical or finan- 14 cial assistance under any other law. 15 (b) CONSULTATION AND COORDINATION.—The head 16 of any Federal agency planning to conduct activities that 17 may have an impact on the Heritage Area is encouraged 18 to consult and coordinate the activities with the Secretary 19 and the local coordinating entity to the extent practicable. 20 (c) OTHER FEDERAL AGENCIES.—Nothing in this 21 Act— 22 (1) modifies, alters, or amends any law or regu- 23 lation authorizing a Federal agency to manage Fed- 24 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 11 •HR 670 IH eral land under the jurisdiction of the Federal agen- 1 cy; 2 (2) limits the discretion of a Federal land man- 3 ager to implement an approved land use plan within 4 the boundaries of the Heritage Area; or 5 (3) modifies, alters, or amends any authorized 6 use of Federal land under the jurisdiction of a Fed- 7 eral agency. 8 SEC. 7. PRIVATE PROPERTY AND REGULATORY PROTEC- 9 TIONS. 10 Nothing in this Act— 11 (1) abridges the rights of any property owner 12 (whether public or private), including the right to re- 13 frain from participating in any plan, project, pro- 14 gram, or activity conducted within the Heritage 15 Area; 16 (2) requires any property owner to permit pub- 17 lic access (including access by Federal, State, or 18 local agencies) to the property of the property 19 owner, or to modify public access or use of property 20 of the property owner under any other Federal, 21 State, or local law; 22 (3) alters any duly adopted land use regulation, 23 approved land use plan, or other regulatory author- 24 ity of any Federal, State, or local agency, or conveys 25 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 12 •HR 670 IH any land use or other regulatory authority to the 1 local coordinating entity; 2 (4) authorizes or implies the reservation or ap- 3 propriation of water or water rights; 4 (5) diminishes the authority of the State to 5 manage fish and wildlife, including the regulation of 6 fishing and hunting within the Heritage Area; or 7 (6) creates any liability, or affects any liability 8 under any other law, of any private property owner 9 with respect to any person injured on the private 10 property. 11 SEC. 8. EVALUATION; REPORT. 12 (a) IN GENERAL.—Not later than 3 years before the 13 date on which authority for Federal funding terminates 14 for the Heritage Area, the Secretary shall— 15 (1) conduct an evaluation of the accomplish- 16 ments of the Heritage Area; and 17 (2) prepare a report in accordance with sub- 18 section (c). 19 (b) EVALUATION.—An evaluation conducted under 20 subsection (a)(1) shall— 21 (1) assess the progress of the local coordinating 22 entity with respect to— 23 (A) accomplishing the purposes of this Act 24 for the Heritage Area; and 25 VerDate Sep 11 2014 20:12 Feb 21, 2021 Jkt 019200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 E:\BILLS\H670.IH H670 pamtmann on DSKBC07HB2PROD with BILLS 13 •HR 670 IH (B) achieving the goals and objectives of 1 the approved management plan for the Heritage 2 Area; 3 (2) analyze the Federal, State, local, and [Text truncated for display.
