Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. CONGRESSIONAL AUTHORIZATION OF DECLARA- 1 TIONS OF NATIONAL MONUMENTS AND RE- 2 STRICTIONS ON PUBLIC USE. 3 (a) DECLARATIONS OF NATIONAL MONUMENTS.— 4 Section 320301 of title 54, United States Code, is amend- 5 ed— 6 (1) in subsection (a), by striking ‘‘The Presi- 7 dent may’’ and inserting ‘‘After obtaining congres- 8 sional approval of a proposed national monument 9 and certifying compliance with the National Envi- 10 ronmental Policy Act of 1969 (42 U.S.C. 4321 et 11 seq.) with respect to the proposed national monu- 12 ment, and subject to subsection (e), the President 13 may’’; and 14 (2) by adding at the end the following: 15 ‘‘(e) REQUIREMENTS FOR DECLARATIONS OF MA- 16 RINE NATIONAL MONUMENTS.— 17 ‘‘(1) REQUIREMENTS.—The President may not 18 declare any area of the exclusive economic zone to 19 be a national monument unless— 20 ‘‘(A) such declaration is specifically au- 21 thorized by an Act of Congress; 22 ‘‘(B) the President has submitted a pro- 23 posal to make such declaration to the Governor 24 of each State, and of each territory, any part 25 VerDate Sep 11 2014 19:31 Feb 20, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H629.IH H629 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 629 IH of which is located within 200 nautical miles of 1 that area; 2 ‘‘(C) each such Governor submits to the 3 President notice that the legislature of that 4 State or territory has approved the proposal; 5 and 6 ‘‘(D) the declaration is substantially the 7 same as the proposal. 8 ‘‘(2) EXCLUSIVE ECONOMIC ZONE DEFINED.— 9 In this subsection the term ‘exclusive economic zone’ 10 means the zone established by Proclamation Num- 11 bered 5030, dated March 10, 1983.’’. 12 (b) RESTRICTIONS ON PUBLIC USE.—Chapter 3203 13 of title 54, United States Code, is amended— 14 (1) by adding at the end the following: 15 ‘‘§ 320304.
