A BILL
To amend title 49, United States Code, to require Amtrak
to convey of certain properties to the Commonwealth
of Pennsylvania, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. EXPEDITED PROPERTY CONVEYANCE.

Section 24301 of title 49, United States Code, is
4
amended by adding at the end the following:
5
‘‘(p) EXPEDITED PROPERTY CONVEYANCE.—
6
‘‘(1) On or before June 30, 2021:

‘‘(A) Amtrak shall convey to the Common-

wealth of Pennsylvania all of its rights and title
2
in—
3
‘‘(i) the Keystone Line and stations
4
between
Harrisburg
and
Philadelphia,
5
Pennsylvania, including all of Amtrak’s
6
passenger stations along that line east of
7
William H. Gray III 30th Street Station in
8
Philadelphia, Pennsylvania;
9
‘‘(ii) all of Amtrak’s other passenger
10
stations, excluding Amtrak’s William H.
11
Gray III 30th Street Station and North
12
Philadelphia Station, located within the
13
Commonwealth along Amtrak’s Northeast
14
Corridor and used for commuter rail pas-
15
senger service as of May 1, 2020;
16
‘‘(iii) sections of track on or along
17
Amtrak’s Northeast Corridor immediately
18
south of William H. Gray III 30th Street
19
Station in Philadelphia that are solely used
20
by and maintained by Southeastern Penn-
21
sylvania Transportation Authority; and
22
‘‘(iv) Amtrak’s obligations to the
23
United States as determined by the Sec-
24
retary under subparagraph (C).

‘‘(B) Amtrak shall be entitled to use the
1
properties conveyed pursuant to subparagraph
2
(A) on the same terms and conditions and right
3
to determination by the United States Surface
4
Transportation Board as afforded commuter
5
authorities operating over Amtrak’s lines pursu-
6
ant to section 24903.
7
‘‘(C) The Secretary shall—
8
‘‘(i) determine what portion of the
9
note and mortgage the Secretary obtained
10
from Amtrak to secure the amounts paid
11
by the United States to acquire Amtrak’s
12
Northeast Corridor should be allocated,
13
based on the original purchase price paid
14
by the United States, to the properties to
15
be conveyed under subparagraph (A); and
16
‘‘(ii) at the time of the conveyance
17
under subparagraph (A), assign that por-
18
tion of the note and mortgage to the Com-
19
monwealth of Pennsylvania.
20
‘‘(2) Amtrak shall be entitled to no compensa-
21
tion for the conveyances mandated in paragraph
22
(1)(A), and, exclusively for the purposes of this sub-
23
section, notwithstanding any other provision of the

law, shall be deemed an agency of the United
