Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. BORDER WALL TRUST FUND. 1 (a) BORDER WALL TRUST FUND.—At the end of 2 subchapter III of chapter 33 of title 31, United States 3 Code, insert the following: 4 ‘‘§ 3344. Border Wall Trust Fund. 5 ‘‘(a) IN GENERAL.— 6 ‘‘(1) RECEIVE GIFTS.—Notwithstanding section 7 3113 of title 31, the Secretary of the Treasury may 8 accept for the Government a gift of money on the 9 condition that it be used to plan, design, construct, 10 or maintain a barrier along the international border 11 between the United States and Mexico. 12 ‘‘(2) TRUST FUND.—Not later than 60 days 13 after the date of enactment of this section, the Sec- 14 retary of the Treasury shall— 15 ‘‘(A) establish an account, to be known as 16 the ‘Border Wall Trust Fund’, into which 17 money received as gifts under this section shall 18 be deposited; and 19 ‘‘(B) create a publicly accessible website to 20 receive such gifts. 21 ‘‘(3) APPROPRIATION.—Money deposited in the 22 Border Wall Trust Fund is appropriated to the Sec- 23 retary of Homeland Security and may be expended 24 to plan, design, construct, or maintain a barrier 25 along the international border between the United 26 VerDate Sep 11 2014 23:45 Feb 14, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H416.IH H416 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 416 IH States and Mexico. Such funds may not be used for 1 any other purpose.’’. 2 (b) CLERICAL AMENDMENT.—The table of contents 3 for such chapter is amended by inserting at the end the 4 following: 5 ‘‘3344. Border Wall Trust Fund.’’. SEC. 3. COMMEMORATIVE DISPLAY. 6 (a) CONSTRUCTION.—The Secretary of Homeland 7 Security shall, at a time determined by the Secretary and 8 in a manner consistent with the security mission of the 9 border barrier, provide for a commemorative display as an 10 integrated part of the barrier under section 3344 of title 11 31, United States Code, as added by section 2, recognizing 12 individuals who contributed to the Border Wall Trust 13 Fund. 14 (b) LENGTH.—The display described in subsection 15 (a) shall be one mile in length, unless the Secretary deter- 16 mines that length to be impracticable, in which case it 17 shall be as close to that length as the Secretary determines 18 practicable consistent with the security mission of such 19 barrier. 20 (c) DESIGNATION OF FUNDS.—The Secretary of the 21 Treasury shall provide a process by which a donor may 22 designate the donation of that donor to fund construction 23 of the commemorative display under this section. 24 VerDate Sep 11 2014 23:45 Feb 14, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H416.IH H416 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 416 IH (d) NOTIFICATION TO THE PUBLIC.—The Secretary 1 of the Treasury shall display on the website described in 2 section 3344(a)(2) of such title, as added by section 2, 3 the following: 4 (1) A total estimated cost for the commemora- 5 tive display. 6 (2) A notification that donations to the Border 7 Wall Trust Fund not designated under subsection 8 (c) will be used exclusively to plan, design, construct, 9 or maintain a barrier along the international border 10 between the United States and Mexico. 11 Æ VerDate Sep 11 2014 23:45 Feb 14, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H416.IH H416 pbinns on DSKJLVW7X2PROD with BILLS
