AN ACT
To amend the Homeland Security Act of 2002 to make
technical corrections to the requirement that the Sec-
retary of Homeland Security submit quadrennial home-
land security reviews, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Quadrennial Homeland
4
Security Review Technical Corrections Act of 2021’’.

SEC. 2. TECHNICAL CORRECTIONS TO QUADRENNIAL

HOMELAND SECURITY REVIEW.
2
(a) IN GENERAL.—Section 707 of the Homeland Se-
3
curity Act of 2002 (6 U.S.C. 347) is amended—
4
(1) in subsection (a)(3)—
5
(A) in subparagraph (B), by striking
6
‘‘and’’ after the semicolon at the end;
7
(B) by redesignating subparagraph (C) as
8
subparagraph (D); and
9
(C) by inserting after subparagraph (B)
10
the following new subparagraph:
11
‘‘(C) representatives from appropriate ad-
12
visory committees established pursuant to sec-
13
tion 871, including the Homeland Security Ad-
14
visory Council and the Homeland Security
15
Science and Technology Advisory Committee, or
16
otherwise established, including the Aviation
17
Security Advisory Committee established pursu-
18
ant to section 44946 of title 49, United States
19
Code; and’’;
20
(2) in subsection (b)—
21
(A) in paragraph (2), by inserting before
22
the semicolon at the end the following: ‘‘based
23
on the risk assessment required pursuant to
24
subsection (c)(2)(B)’’;

(B) in paragraph (3)—

(III) by inserting ‘‘and risks’’ be-

fore ‘‘to national homeland’’; and

(IV) by inserting ‘‘and’’ after the

(C) by redesignating paragraph (3) as

paragraph (4); and

following new paragraph:

‘‘(3) DOCUMENTATION.—The Secretary shall
13
retain and, upon request, provide to Congress the
14
following documentation regarding each quadrennial
15
homeland security review:
16
‘‘(A) Records regarding the consultation
17
carried out pursuant to subsection (a)(3), in-
18
cluding the following:
19
‘‘(i) All written communications, in-
20
cluding communications sent out by the
21
Secretary and feedback submitted to the
22
Secretary through technology, online com-
23
munications tools, in-person discussions,
24
and the interagency process.

‘‘(ii) Information on how feedback re-

ceived by the Secretary informed each such
2
quadrennial homeland security review.
3
‘‘(B) Information regarding the risk as-
4
sessment required pursuant to subsection
5
(c)(2)(B), including the following:
6
‘‘(i) The risk model utilized to gen-
7
erate such risk assessment.
8
‘‘(ii) Information, including data used
9
in the risk model, utilized to generate such
10
risk assessment.
11
‘‘(iii) Sources of information, includ-
12
ing other risk assessments, utilized to gen-
13
erate such risk assessment.
14
‘‘(iv) Information on assumptions,
15
weighing factors, and subjective judgments
16
utilized to generate such risk assessment,
17
together with information on the rationale
18
or basis thereof.’’;
19
(4) by redesignating subsection (d) as sub-
20
section (e); and
21
(5) by inserting after subsection (c) the fol-
22
lowing new subsection:
23
‘‘(d) REVIEW.—Not later than 90 days after the sub-
24
mission of each report required under subsection (c)(1),

the Secretary shall provide to the Committee on Homeland

Security of the House of Representatives and the Com-
2
mittee on Homeland Security and Governmental Affairs
3
of the Senate information on the degree to which the find-
4
ings and recommendations developed in the quadrennial
5
homeland security review that is the subject of such report
6
were integrated into the acquisition strategy and expendi-
7
ture plans for the Department.’’.
8
(b) EFFECTIVE DATE.—The amendments made by
9
this Act shall apply with respect to a quadrennial home-
10
land security review conducted after December 31, 2021.
