To prohibit the sale of shark parts, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Shark Sales Elimi-
4
nation Act of 2021’’.

SEC. 2. PROHIBITION ON SALE OF SHARK PARTS.

(a) PROHIBITION.—Except as provided in subsection
7
(c), no person shall possess, offer for sale, sell, or purchase
8
any shark part or product containing any shark part.
9
(b) PENALTY.—For purposes of section 308(a) of the
10
Magnuson-Stevens Fishery Conservation and Manage-
11
ment Act (16 U.S.C. 1858(a)), a violation of this section

shall be treated as an act prohibited by section 307 of

that Act (16 U.S.C. 1857).

(c) EXEMPTION FOR TRADITIONAL FISHERIES, EDU-
3
CATION, AND SCIENCE.—Subsection (a) shall not apply
4
with respect to possession of a shark part that was taken
5
lawfully under a State, territorial, or Federal license or
6
permit to take or land sharks, if the shark part is sepa-
7
rated from the shark in a manner consistent with the li-
8
cense or permit and is—
9
(1) destroyed or discarded;
10
(2) used for noncommercial subsistence pur-
11
poses in accordance with State or territorial law; or
12
(3) used solely for display or research purposes
13
by a museum, college, or university, or other person
14
under a State or Federal permit to conduct non-
15
commercial scientific research.

(d) STATE AUTHORITY.—Nothing in this Act affects
17
any right of a State or territory of the United States to
18
adopt or enforce any regulation or standard that is more
19
stringent than a regulation or standard in effect under
20
this Act.

(e) DEFINITIONS.—In this section:

(1) SHARK.—The term ‘‘shark’’ means any spe-
23
cies

(2) SHARK
PART.—The term ‘‘shark part’’

means any shark or raw, dried, or otherwise proc-

essed detached part of a shark.
