Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. MASKS REQUIRED IN FEDERAL FACILITIES. 1 (a) MASKS REQUIRED.—Each Federal agency shall 2 take action to ensure that an individual is required to wear 3 a face mask if such individual is— 4 (1) inside a Federal facility under the jurisdic- 5 tion of such agency; and 6 (2) within 6 feet of another individual. 7 (b) ENFORCEMENT.—A Federal agency may remove 8 or deny service to an individual who fails to wear a mask 9 in accordance with subsection (a). 10 (c) PROVISION OF MASKS.—Each Federal agency 11 shall make face masks available at each entrance to a Fed- 12 eral facility at which such agency maintains a presence. 13 (d) FUNDING.—A Federal agency shall use funds 14 otherwise appropriated to such agency to carry out this 15 section. 16 (e) DEFINITIONS.—In this section, the following defi- 17 nitions apply: 18 (1) CAPITOL BUILDINGS.—The term ‘‘Capitol 19 Buildings’’ has the meaning given such term in sec- 20 tion 5101 of title 40, United States Code. 21 (2) FACE MASK.—The term ‘‘face mask’’ means 22 a mask covering both the nose and mouth that rea- 23 sonably can be expected to minimize the trans- 24 mission of SARS–CoV–2. 25 VerDate Sep 11 2014 00:21 Feb 07, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H348.IH H348 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 348 IH (3) FEDERAL AGENCY.—The term ‘‘Federal 1 agency’’ has the meaning given such term in section 2 102 of title 40, United States Code, except that with 3 respect to Capitol Buildings, the Office of the Archi- 4 tect of the Capitol shall be treated as the relevant 5 Federal agency. 6 (4) FEDERAL FACILITY.—The term ‘‘Federal 7 facility’’ means— 8 (A) a building or any part thereof owned 9 or leased by the Federal Government for use by 10 a Federal agency; and 11 (B) the Capitol Buildings or any part 12 thereof. 13 (f) TERMINATION.—The requirements of this section 14 shall cease to have effect on the date on which the Director 15 of the National Institute of Allergy and Infectious Dis- 16 eases determines, and publishes in the Federal Register 17 a notification of such determination, that the requirement 18 to wear a mask is no longer necessary to prevent trans- 19 mission of SARS–CoV–2. 20 Æ VerDate Sep 11 2014 00:21 Feb 07, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H348.IH H348 kjohnson on DSK79L0C42PROD with BILLS
