SHORT TITLE. 1 This Act may be cited as the ‘‘United States Anti- 2 Doping Agency Reauthorization Act of 2021’’. 3 SEC. 2. FINDINGS. 4 Congress makes the following findings: 5 (1) The United States Anti-Doping Agency— 6 (A) is the independent national anti-doping 7 organization of the United States; and 8 (B) manages the anti-doping program, re- 9 sults management processes, drug reference re- 10 sources, and athlete education for all United 11 States Olympic Committee-recognized national 12 governing bodies and the athletes and events of 13 such national governing bodies. 14 (2) The United States Anti-Doping Agency con- 15 tributes to the advancement of clean sport through 16 scientific research, anti-doping education, and out- 17 reach programs, and the mission of the United 18 States Anti-Doping Agency is to preserve the integ- 19 rity of competition and protect the rights of athletes. 20 (3) Participation in youth sports has the poten- 21 tial to equip young athletes with important skills 22 and values necessary for success in life, and it is es- 23 sential that the culture of youth sports emphasizes 24 such skills and values. 25 VerDate Sep 11 2014 02:36 Apr 16, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H172.RFS H172 pbinns on DSKJLVW7X2PROD with BILLS 3 HR 172 RFS (4) The TrueSport program of the United 1 States Anti-Doping Agency partners with youth 2 sport organizations across the United States to pro- 3 mote sportsmanship, character building, and healthy 4 performance through the use of targeted educational 5 materials designed to promote a positive youth sport 6 experience. 7 (5) In modifying the authority of the United 8 States Anti-Doping Agency to include the promotion 9 of the positive values of youth sport, Congress sends 10 a strong signal that the goals of youth sport should 11 include instilling in young athletes the values of in- 12 tegrity, respect, teamwork, courage, and responsi- 13 bility. 14 (6) Due to the unique leadership position of the 15 United States in the global community, adequate 16 funding of the anti-doping and clean sport programs 17 of the United States Anti-Doping Agency is impera- 18 tive to the preparation for the 2028 Summer Olym- 19 pic Games, which will be held in Los Angeles, Cali- 20 fornia. 21 (7) Increased appropriations for fiscal years 22 2022 through 2030 would enable the United States 23 Anti-Doping Agency to directly affect the integrity 24 VerDate Sep 11 2014 02:36 Apr 16, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H172.RFS H172 pbinns on DSKJLVW7X2PROD with BILLS 4 HR 172 RFS and well-being of sport, both domestically and inter- 1 nationally. 2 SEC. 3. MODIFICATIONS OF AUTHORITY. 3 Section 701 of the Office of National Drug Control 4 Policy Reauthorization Act of 2006 (21 U.S.C. 2001) is 5 amended— 6 (1) in subsection (b)— 7 (A) by amending paragraph (1) to read as 8 follows: 9 ‘‘(1)(A) serve as the independent anti-doping 10 organization for the amateur athletic competitions 11 recognized by the United States Olympic and 12 Paralympic Committee; 13 ‘‘(B) be responsible for certifying in advance 14 any testing conducted by international organizations 15 under the World Anti-Doping Code for international 16 amateur athletes and athletic competitions occurring 17 within the jurisdiction of the United States; and 18 ‘‘(C) be recognized worldwide as the inde- 19 pendent national anti-doping organization for the 20 United States;’’; 21 (B) in paragraph (4), by striking the pe- 22 riod at the end and inserting ‘‘; and’’; and 23 (C) by adding at the end the following: 24 VerDate Sep 11 2014 02:36 Apr 16, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H172.RFS H172 pbinns on DSKJLVW7X2PROD with BILLS 5 HR 172 RFS ‘‘(5) promote a positive youth sport experience 1 by using a portion of the funding of the United 2 States Anti-Doping Agency to provide educational 3 materials on sportsmanship, character building, and 4 healthy performance for the athletes, parents, and 5 coaches who participate in youth sports.’’; and 6 (2) by adding at the end the following: 7 ‘‘(c) DUE PROCESS IN ARBITRATION PRO- 8 CEEDINGS.—Any action taken by the United States Anti- 9 Doping Agency to enforce a policy, procedure, or require- 10 ment of the United States Anti-Doping Agency against a 11 person with respect to a violation of Federal law, including 12 an investigation, a disciplinary action, a sanction, or any 13 other administrative action, shall be carried out in a man- 14 ner that provides due process protection to the person.’’. 15 SEC. 4. AUTHORIZATION OF APPROPRIATIONS. 16 Section 703 of the Office of National Drug Control 17 Policy Reauthorization Act of 2006 (21 U.S.C. 2003) is 18 amended to read as follows: 19 ‘‘SEC. 703. AUTHORIZATION OF APPROPRIATIONS. 20 ‘‘There are authorized to be appropriated to the 21 United States Anti-Doping Agency— 22 ‘‘(1) for fiscal year 2022, $15,500,000; 23 ‘‘(2) for fiscal year 2023, $16,200,000; 24 ‘‘(3) for fiscal year 2024, $16,900,000; 25 VerDate Sep 11 2014 02:36 Apr 16, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H172.RFS H172 pbinns on DSKJLVW7X2PROD with BILLS 6 HR 172 RFS ‘‘(4) for fiscal year 2025, $17,700,000; 1 ‘‘(5) for fiscal year 2026, $18,500,000; 2 ‘‘(6) for fiscal year 2027, $19,800,000; 3 ‘‘(7) for fiscal year 2028, $22,100,000; 4 ‘‘(8) for fiscal year 2029, $24,900,000; and 5 ‘‘(9) for fiscal year 2030, $23,700,000.’’. 6 SEC. 5. INFORMATION SHARING. 7 Except as otherwise prohibited by law and except in 8 cases in which the integrity of a criminal investigation 9 would be affected, pursuant to the obligation of the United 10 States under Article 7 of the United Nations Educational, 11 Scientific, and Cultural Organization International Con- 12 vention Against Doping in Sport done at Paris October 13 19, 2005, and ratified by the United States in 2008, the 14 Attorney General, the Secretary of Homeland Security, 15 and the Commissioner of Food and Drugs shall provide 16 to the United States Anti-Doping Agency any relevant in- 17 formation relating to the prevention of the use of perform- 18 ance-enhancing drugs or the prohibition of performance- 19 enhancing methods. 20 Passed the House of Representatives April 14, 2021.
