REVOCATION OR DENIAL OF PASSPORTS TO INDI- 1 VIDUALS AFFILIATED WITH FOREIGN TER- 2 RORIST ORGANIZATIONS. 3 The Act entitled ‘‘An Act to regulate the issue and 4 validity of passports, and for other purposes’’, approved 5 July 3, 1926 (22 U.S.C. 211a et seq.), commonly known 6 as the ‘‘Passport Act of 1926’’, is amended by adding at 7 the end the following new section: 8 ‘‘SEC. 4. AUTHORITY TO DENY OR REVOKE PASSPORT. 9 ‘‘(a) INELIGIBILITY.— 10 ‘‘(1) ISSUANCE.—Except as provided under 11 subsection (b), the Secretary of State may refuse to 12 issue a passport to any individual whom the Sec- 13 retary has determined has aided, assisted, abetted, 14 or otherwise helped an organization the Secretary 15 has designated as a foreign terrorist organization 16 pursuant to section 219 of the Immigration and Na- 17 tionality Act (8 U.S.C. 1189). 18 ‘‘(2) REVOCATION.—The Secretary of State 19 may revoke a passport previously issued to any indi- 20 vidual described in paragraph (1). 21 ‘‘(b) RIGHT OF REVIEW.—Any individual who, in ac- 22 cordance with this section, is denied issuance of a passport 23 by the Secretary of State, or whose passport is revoked 24 by the Secretary, may request a hearing before the Sec- 25 VerDate Sep 11 2014 19:29 Jan 15, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H86.IH H86 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 86 IH retary not later than 60 days after receiving notice of such 1 denial or revocation. 2 ‘‘(c) REPORT.— 3 ‘‘(1) IN GENERAL.—If the Secretary of State 4 refuses to issue or revokes a passport pursuant to 5 subsection (a), or if, subsequent to a hearing pursu- 6 ant to subsection (b), the Secretary issues or cancels 7 a revocation of a passport that was the subject of 8 such a hearing, the Secretary shall, not later than 9 30 days after such refusal or revocation, or such 10 issuance or cancellation, submit to the Committee on 11 Foreign Affairs of the House of Representatives and 12 the Committee on Foreign Relations of the Senate 13 a report on such refusal, revocation, issuance, or 14 cancellation, as the case may be. 15 ‘‘(2) FORM.—The report submitted under para- 16 graph (1) may be submitted in classified or unclassi- 17 fied form. 18 ‘‘(d) DEFINITION.—In this section, the term ‘pass- 19 port’ includes a passport card.’’. 20 Æ VerDate Sep 11 2014 19:29 Jan 15, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H86.IH H86 pamtmann on DSKBC07HB2PROD with BILLS
