What This Bill Does
This bill establishes the Springfield 1908 Race Riot National Monument in Illinois as part of the National Park System. The monument will preserve and protect resources related to the 1908 Springfield Race Riot and its connection to the founding of the National Association for the Advancement of Colored People. SEC. 2. DEFINITIONS.

In this Act:

(1)
COMMISSION.—The
term
‘‘Commission’’

means the Springfield 1908 Advisory Commission
4
established by section 3(g)(1).

(2) MAP.—The term ‘‘Map’’ means the map en-
6
titled ‘‘Springfield 1908 Race Riot National Memo-
7
rial Proposed Boundary’’, numbered 687/148588,
8
and dated February 2023.

(3) MEMORIAL.—The term ‘‘Memorial’’ means
10
the memorial required to be constructed under sec-
11
tion 3(a)(1)(B), including the structure, interpretive
12
signage, and associated infrastructure.

(4) NATIONAL
MONUMENT.—The term ‘‘Na-
14
tional Monument’’ means the Springfield 1908 Race
15
Riot

Monument
established

(a) ESTABLISHMENT.—

(1) IN GENERAL.—Subject to paragraph (2),

there is established in the State the Springfield 1908
2
Race Riot National Monument as a unit of the Na-
3
tional Park System—
4
(A) to preserve, protect, and interpret for
5
the benefit of present and future generations
6
resources associated with the Springfield Race
7
Riot of 1908 and the role of the Riot in the for-
8
mation of the National Association for the Ad-
9
vancement of Colored People; and
10
(B) that shall include the construction of a
11
permanent memorial, within the boundary of
12
the National Monument, to—
13
(i) the victims, survivors, and de-
14
scendants of survivors of the Springfield
15
Race Riot of 1908; and
16
(ii) the Springfield community.

(2)
CONDITIONS.—The
National
Monument
18
shall not be established until the date on which the
19
Secretary acquires sufficient land within the bound-
20
ary of the National Monument to constitute a man-
21
ageable unit.

(1) IN GENERAL.—The boundary of the Na-

tional Monument shall be the boundary generally de-
2
picted on the Map.
3
(2) CORRECTION OF ERRORS.—The Secretary
4
may correct minor errors in the Map.
5
(c) ACQUISITION AUTHORITY.—The Secretary may
6
acquire any land or interest in land located within the
7
boundary of the National Monument by—
8
(1) donation;
9
(2)
purchase
with
donated
or
appropriated
10
funds; or
11
(3) exchange.
12
(d) ADMINISTRATIVE SITES AND VISITOR FACILI-
13
TIES.—To facilitate the administration of the National
14
Monument, the Secretary may expend appropriated funds
15
to acquire or lease essential facilities for the administra-
16
tion of the National Monument and visitor services outside
17
the boundary, but within the vicinity, of the National
18
Monument.

(e)
MEMORIAL.—In
accordance
with
subsection
20
(a)(1)(B), the Secretary shall, using donated or appro-
21
priated funds, construct a Memorial within the boundary
22
of the National Monument.
23
(f) AGREEMENTS.—The Secretary may enter into
24
agreements with—

(1) the city of Springfield or other public or pri-
1
vate entities for the purpose of establishing, man-
2
aging, and operating within or outside of the bound-
3
ary of the National Monument facilities for adminis-
4
tration and visitor services authorized under sub-
5
section (e); and
6
(2) other public or private entities for—
7
(A) the construction of the Memorial;
8
(B) the interpretation of sites associated
9
with the Springfield Race Riot of 1908 located
10
within or outside the boundary of the National
11
Monument; and
12
(C) other purposes of this Act.

(g) SPRINGFIELD 1908 ADVISORY COMMISSION.—
14
(1) ESTABLISHMENT.—There is established an
15
advisory commission, to be known as the ‘‘Spring-
16
field 1908 Advisory Commission’’, to advise the Sec-
17
retary with respect to the management and develop-
18
ment of the National Monument.
19
(2) MEMBERSHIP.—The Commission shall be
20
composed of 11 members, to be appointed by the
21
Secretary, of whom—
22
(A) 3 members shall reside in the city of
23
Springfield or Sangamon County in the State;

(B) 3 members shall be appointed after
1
consideration of recommendations submitted by
2
the Governor of the State;
3
(C) 3 members shall be appointed after
4
consideration of recommendations submitted by
5
the Mayor of the city of Springfield in the
6
State; and
7
(D) 2 members shall be appointed who
8
have experience in the field of historic preserva-
9
tion or the purposes for which the National
10
Monument was established.
11
(3) TERM.—
12
(A) IN GENERAL.—A member of the Com-
13
mission shall be appointed for a term of 5
14
years.
15
(B)
SUCCESSORS.—Notwithstanding
the
16
expiration of a 5-year term of a member of the
17
Commission, a member of the Commission may
18
continue to serve on the Commission until the
19
date on which—
20
(i) the member is reappointed by the
21
Secretary; or
22
(ii) a successor is appointed by the
23
Secretary.

(4) CHAIRPERSON.—The Commission shall have
1
a Chairperson, who shall be elected by the members
2
of the Commission.
3
(5)
BYLAWS.—The
Commission
shall
adopt
4
such bylaws as the Commission considers necessary
5
to carry out the duties of the Commission under this
6
subsection.
7
(6) VACANCIES.—A vacancy on the Commission
8
shall be filled in the same manner in which the origi-
9
nal appointment was made.
10
(7) QUORUM.—A majority of the members of
11
the Commission shall constitute a quorum.
12
(8) COMPENSATION.—Members of the Commis-
13
sion shall serve without compensation, except that
14
the Secretary may pay the expenses incurred by the
15
Commission in carrying out the duties of the Com-
16
mission under this subsection.
17
(9)
FACA
NONAPPLICABILITY.—Section
18
1013(b) of title 5, United States Code, shall not
19
apply to the Commission.
20
(10)
TERMINATION.—The
Commission
shall
21
terminate on the date that is 12 years after the date
22
of enactment of this Act.

ister the National Monument in accordance with—
2
(A) this Act; and
3
(B) the laws generally applicable to units
4
of the National Park System.

(2) MANAGEMENT PLAN.—

(A)
DEADLINE
FOR
COMPLETION.—Not
7
later than 3 years after the date on which funds
8
are first made available to the Secretary for the
9
preparation of a general management plan for
10
the National Monument, the Secretary shall
11
prepare a general management plan for the Na-
12
tional Monument in accordance with section
13
100502 of title 54, United States Code.
14
(B) SUBMISSION TO CONGRESS.—On com-
15
pletion of the general management plan under
16
subparagraph (A), the Secretary shall submit to
17
the Committee on Energy and Natural Re-
18
sources of the Senate and the Committee on
19
Natural Resources of the House of Representa-
20
tives the general management plan prepared
21
under that subparagraph.

(3) REQUIRED CONSULTATION.—The Secretary
23
shall consult with the Commission on matters relat-

(a) ESTABLISHMENT.—

(1) IN
GENERAL.—Subject to paragraph (2),
4
there is established in the State the Springfield 1908
5
Race Riot National Monument as a unit of the Na-
6
tional Park System to preserve, protect, and interpret
7
for the benefit of present and future generations re-
8
sources associated with the Springfield Race Riot of
9
1908 and the role of the Riot in the formation of the
10
National Association for the Advancement of Colored
11
People.

(2) CONDITIONS.—The National Monument shall
13
not be established until the date on which the Sec-
14
retary determines that sufficient land has been ac-
15
quired within the boundary of the National Monu-
16
ment to constitute a manageable unit.

(b) BOUNDARIES.—

(1) IN GENERAL.—The boundary of the National
19
Monument shall be the boundary generally depicted
20
on the Map.
21
(2) AVAILABILITY OF MAP.—The Map shall be on
22
file and available for public inspection in the appro-
23
priate offices of the National Park Service.
