SHORT TITLE. 1 This Act may be cited as the ‘‘Sloan Canyon Con- 2 servation and Lateral Pipeline Act’’. 3 SEC. 2. DEFINITIONS. 4 In this Act: 5 (1) CONSERVATION AREA.—The term ‘‘Con- 6 servation Area’’ means the Sloan Canyon National 7 Conservation Area. 8 (2) SECRETARY.—The term ‘‘Secretary’’ means 9 the Secretary of the Interior (acting through the Di- 10 rector of the Bureau of Land Management). 11 SEC. 3. SLOAN CANYON NATIONAL CONSERVATION AREA 12 BOUNDARY ADJUSTMENT. 13 (a) BOUNDARY ADJUSTMENT.— 14 (1) MAP.—Section 603(4) of the Sloan Canyon 15 National Conservation Area Act (16 U.S.C. 460qqq– 16 1(4)) is amended by striking ‘‘map entitled ‘South- 17 ern Nevada Public Land Management Act’ and 18 dated October 1, 2002’’ and inserting ‘‘map entitled 19 ‘Proposed Sloan Canyon Expansion’ and dated June 20 7, 2023’’. 21 (2) ACREAGE.—Section 604(b) of the Sloan 22 Canyon National Conservation Area Act (16 U.S.C. 23 460qqq–2(b)) is amended by striking ‘‘48,438’’ and 24 inserting ‘‘57,728’’. 25 3 † S 2042 ES (b) RIGHT-OF-WAY.—Section 605 of the Sloan Can- 1 yon National Conservation Area Act (16 U.S.C. 460qqq– 2 3) is amended by adding at the end the following: 3 ‘‘(h) HORIZON LATERAL PIPELINE RIGHT-OF- 4 WAY.— 5 ‘‘(1) IN GENERAL.—Notwithstanding sections 6 202 and 503 of the Federal Land Policy Manage- 7 ment Act of 1976 (43 U.S.C. 1712, 1763) and sub- 8 ject to valid existing rights and paragraph (3), the 9 Secretary of the Interior, acting through the Direc- 10 tor of the Bureau of Land Management (referred to 11 in this subsection as the ‘Secretary’), shall, not later 12 than 1 year after the date of enactment of this sub- 13 section, grant to the Southern Nevada Water Au- 14 thority (referred to in this subsection as the ‘Author- 15 ity’), not subject to the payment of rents or other 16 charges, the temporary and permanent water pipe- 17 line infrastructure, and outside the boundaries of the 18 Conservation Area, powerline, facility, and access 19 road rights-of-way depicted on the map for the pur- 20 poses of— 21 ‘‘(A) performing geotechnical investigations 22 within the rights-of-way; and 23 ‘‘(B) constructing and operating water 24 transmission and related facilities. 25 4 † S 2042 ES ‘‘(2) EXCAVATION AND DISPOSAL.— 1 ‘‘(A) IN GENERAL.—The Authority may, 2 without consideration, excavate and use or dis- 3 pose of sand, gravel, minerals, or other mate- 4 rials from the tunneling of the water pipeline 5 necessary to fulfill the purpose of the rights-of- 6 way granted under paragraph (1). 7 ‘‘(B) MEMORANDUM OF UNDER- 8 STANDING.—Not later than 30 days after the 9 date on which the rights-of-way are granted 10 under paragraph (1), the Secretary and the Au- 11 thority shall enter into a memorandum of un- 12 derstanding identifying Federal land on which 13 the Authority may dispose of materials under 14 subparagraph (A) to further the interests of the 15 Bureau of Land Management. 16 ‘‘(3) REQUIREMENTS.—A right-of-way issued 17 under this subsection shall be subject to the fol- 18 lowing requirements: 19 ‘‘(A) The Secretary may include reasonable 20 terms and conditions, consistent with section 21 505 of the Federal Land Policy and Manage- 22 ment Act of 1976 (43 U.S.C. 1765), as are nec- 23 essary to protect Conservation Area resources. 24 5 † S 2042 ES ‘‘(B) Construction of the water pipeline 1 shall not permanently adversely affect conserva- 2 tion area surface resources. 3 ‘‘(C) The right-of-way shall not be located 4 through or under any area designated as wilder- 5 ness.’’. 6 (c) PRESERVATION OF TRANSMISSION AND UTILITY 7 CORRIDORS AND RIGHTS-OF-WAY.—The expansion of the 8 Conservation Area boundary under the amendment made 9 by subsection (a)— 10 (1) shall be subject to valid existing rights, in- 11 cluding land within a designated utility transmission 12 corridor or a transmission line right-of-way grant 13 approved by the Secretary in a record of decision 14 issued before the date of enactment of this Act; 15 (2) shall not preclude— 16 (A) any activity authorized in accordance 17 with a designated corridor or right-of-way re- 18 ferred to in paragraph (1), including the oper- 19 ation, maintenance, repair, or replacement of 20 any authorized utility facility within the cor- 21 ridor or right-of-way; or 22 (B) the Secretary from authorizing the es- 23 tablishment of a new utility facility right-of-way 24 within an existing designated transportation 25 6 † S 2042 ES and utility corridor referred to in paragraph (1) 1 in accordance with— 2 (i) the National Environmental Policy 3 Act of 1969 (42 U.S.C. 4321 et seq.) and 4 other applicable laws; and 5 (ii) subject to such terms and condi- 6 tions as the Secretary determines to be ap- 7 propriate; and 8 (3) except as provided in the amendment made 9 by subsection (b), modifies the management of the 10 Conservation Area pursuant to section 605 of the 11 Sloan Canyon National Conservation Area Act (16 12 U.S.C. 460qqq–3). 13 Passed the Senate December 18 (legislative day, De- cember 16), 2024.
