Mr. GRAVES of Missouri introduced the following bill; which was referred to
the Committee on Natural Resources, and in addition to the Committee
on Appropriations, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall within
the jurisdiction of the committee concerned

To establish the Southwestern Power Administration Fund,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Southwestern Power
4
Administration Fund Establishment Act’’.

SEC. 2. DEFINITIONS.

(1) ADMINISTRATOR.—The term ‘‘Adminis-
1
trator’’ means the Administrator of the South-
2
western Power Administration.

(2) FUND.—The term ‘‘Fund’’ means the
4
Southwestern Power Administration Fund estab-
5
lished by section 3(a).
6
(3) SECRETARY.—The term ‘‘Secretary’’ means
7
the Secretary of Energy.

SEC. 3. SOUTHWESTERN POWER ADMINISTRATION FUND.
9
(a) ESTABLISHMENT
OF FUND.—There is estab-
10
lished in the Treasury of the United States a fund, to be
11
known as the ‘‘Southwestern Power Administration
12
Fund’’, consisting of—
13
(1) all receipts, collections, and recoveries of the
14
Southwestern Power Administration, including trust
15
funds;
16
(2) appropriations to the Fund;
17
(3) amounts transferred to the Fund under
18
subsection (b); and
19
(4) amounts deposited in the Fund under the
20
first proviso in the matter under the heading ‘‘OP-
21
ERATION
AND
MAINTENANCE,
SOUTHWESTERN
22
POWER
ADMINISTRATION’’
under
the
heading
23
‘‘POWER MARKETING ADMINISTRATIONS’’
24
under the heading ‘‘DEPARTMENT OF EN-

(b) TRANSFERS TO FUND.—There are transferred to
4
the Fund—
5
(1) unexpended balances in the continuing fund
6
pursuant to the 11th paragraph under the heading
7
‘‘OFFICE OF THE SECRETARY’’ in title I of the
8
Act of October 12, 1949 (16 U.S.C. 825s–1);
9
(2) unexpended balances in the advanced pay-
10
ment fund pursuant to the first proviso in the mat-
11
ter under the heading ‘‘OPERATION AND MAINTE-
12
NANCE, SOUTHWESTERN POWER ADMINISTRATION’’
13
under the heading ‘‘POWER MARKETING AD-
14
MINISTRATIONS’’ under the heading ‘‘Depart-
15
ment of Energy’’ in title III of the Energy and
16
Water Development Appropriations Act, 2005 (16
17
U.S.C. 825s–4); and
18
(3) unexpended balances in the offsetting collec-
19
tions fund pursuant to the fourth and fifth provisos
20
in the matter under the heading ‘‘OPERATION AND
21
MAINTENANCE, SOUTHWESTERN POWER ADMINIS-
22
TRATION’’ under the heading ‘‘POWER MAR-
23
KETING ADMINISTRATIONS’’ under the head-
24
ing ‘‘DEPARTMENT OF ENERGY’’ in title III of

the Energy and Water Development and Related

Agencies Appropriations Act, 2010 (16 U.S.C.
2
825s–7) (as in effect on the day before the date of
3
enactment of this Act).

(c) AVAILABILITY.—Amounts in the Fund shall re-
5
main available until expended.
6
(d) USE.—Amounts in the Fund shall be used by the
7
Secretary, acting through the Administrator, for expenses
8
necessary for—
9
(1) operation and maintenance of power trans-
10
mission facilities;
11
(2) marketing electric power and energy;
12
(3) construction and acquisition of transmission
13
lines, substations, and appurtenant facilities; and
14
(4) administrative expenses in carrying out the
15
duties of the Secretary under—
16
(A) section 5 of the Act of December 22,
17
1944 (commonly known as the ‘‘Flood Control
18
Act of 1944’’) (16 U.S.C. 825s); and
19
(B) section 1232 of the Energy Policy Act
20
of 2005 (42 U.S.C. 16431).

(e) OBLIGATIONS.—The Secretary, acting through
22
the Administrator, may incur obligations for authorized
23
purposes in advance of appropriations to be liquidated by
24
the Fund.

(f) EXCESS FUNDS.—Annually, the Secretary, acting
1
through the Administrator, shall transfer excess amounts
2
in the Fund to the Treasury of the United States as mis-
3
cellaneous receipts.
4
(g) APPLICABLE LAW.—The provisions of chapter 91
5
of title 31, United States Code, shall apply to the Adminis-
6
trator in carrying out this section in the same manner as
7
the provisions apply to a wholly owned Government cor-
8
poration (as defined in section 9101 of that title).

(h) CONFORMING AMENDMENTS.—
10
(1) The proviso in the matter under the head-
11
ing ‘‘OPERATION
AND
MAINTENANCE, SOUTH-
12
WESTERN
POWER
ADMINISTRATION’’ under the
13
heading ‘‘POWER MARKETING ADMINISTRA-
14
TIONS’’ under the heading ‘‘Department of En-
15
ergy’’ in title III of the Energy and Water Develop-
16
ment Appropriations Act, 2005 (16 U.S.C. 825s–4),
17
is amended—
18
(A) by striking ‘‘in fiscal year 2005’’ and
19
inserting ‘‘on the date of enactment of the
20
Southwestern Power Administration Fund Es-
21
tablishment Act’’; and
22
(B) by striking ‘‘credited to this account’’
23
and inserting ‘‘deposited in the Southwestern
24
Power Administration Fund established by sec-
25
