a final rule with respect to safety management systems required for
certain certificate holders and operators, and for other purposes.

Committee on Transportation and Infrastructure
A BILL
To require the Administrator of the Federal Aviation Admin-
istration to issue a final rule with respect to safety
management systems required for certain certificate hold-
ers and operators, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Brian McDaniel Flight
4
Safety Act’’.
5
SEC. 2. SAFETY MANAGEMENT SYSTEMS.

(a) IN GENERAL.—Not later than 180 days after the
7
date of enactment of this Act, the Administrator of the

Federal Aviation Administration shall issue a final rule

relating to the Notice of Proposed Rulemaking of the Fed-
2
eral Aviation Administration titled ‘‘Safety Management
3
Systems’’, issued on January 11, 2023.

(b) APPLICABILITY.—In issuing a final rule under
5
subsection (a), the Administrator shall ensure that the
6
safety management system requirement under the Notice
7
of Proposed Rulemaking described in subsection (a) is ap-
8
plied to all certificate holders operating under the rules
9
for commuter and on-demand operations under part 135
10
of title 14, Code of Federal Regulations, commercial air
11
tour operators operating under section 91.147 of such
12
title, production certificate holders that are holders or li-
13
censees of a type certificate for the same product, and
14
holders of a type certificate who license out such certifi-
15
cate for production under part 21 of such title.
