ACCELERATING APPLICABILITY OF REQUIREMENT 1 THAT CDC DIRECTOR BE CONFIRMED BY 2 SENATE. 3 Subsection (b) of section 2101 of division FF of the 4 Consolidated Appropriations Act, 2023 (Public Law 117– 5 328) is amended to read as follows: 6 ‘‘(b) APPLICABILITY.— 7 ‘‘(1) IN GENERAL.—The first sentence of sec- 8 tion 305(a) of the Public Health Service Act, as 9 added by subsection (a), applies with respect to any 10 Director of the Centers for Disease Control and Pre- 11 vention appointed on or after June 1, 2023. 12 ‘‘(2) SPECIAL RULE.—Any individual appointed 13 during the period beginning on June 1, 2023, and 14 ending on the date of enactment of this Act to serve 15 as the Director of the Centers for Disease Control 16 and Prevention is deemed to be serving in an acting 17 capacity until the requirements of the first sentence 18 of section 305(a) of the Public Health Service Act, 19 as added by subsection (a), are met.’’. 20 Æ VerDate Sep 11 2014 23:33 Jun 27, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H3813.IH H3813 kjohnson on DSK79L0C42PROD with BILLS
