Mr. PANETTA (for himself, Mr. ADERHOLT, Ms. TITUS, Mr. LAHOOD, and
Mr. BERA) introduced the following bill; which was referred to the Com-
mittee on Ways and Means
A BILL
To authorize the extension of nondiscriminatory treatment
(normal trade relations treatment) to the products of
Kazakhstan.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Kazakhstan Perma-
4
nent Normal Trade Relations Act of 2023’’.

SEC. 2. FINDINGS.

Congress finds the following:
7
(1) Kazakhstan allows its citizens the right and
8
opportunity to emigrate, free of any heavy tax on

emigration or on the visas or other documents re-
1
quired for emigration and free of any tax, levy, fine,
2
fee, or other charge on any citizens, as a con-
3
sequence of the desire of those citizens to emigrate
4
to the country of their choice.

(2) Kazakhstan has been found to be in full
6
compliance with the freedom of emigration require-
7
ments under title IV of the Trade Act of 1974 (19
8
U.S.C. 2431 et seq.) since 1997.
9
(3) Kazakhstan has received normal trade rela-
10
tions treatment since 1992 and signed a bilateral in-
11
vestment treaty agreement with the United States
12
that entered into force in 1994.
13
(4) On November 30, 2015, Kazakhstan offi-
14
cially acceded to the World Trade Organization.

SEC. 3. TERMINATION OF APPLICATION OF TITLE IV OF
16
THE TRADE ACT OF 1974 TO THE PRODUCTS
17
OF KAZAKHSTAN.

(a) PRESIDENTIAL DETERMINATIONS AND EXTEN-
19
SION
OF NONDISCRIMINATORY TREATMENT.—Notwith-
20
standing any provision of title IV of the Trade Act of 1974
21
(19 U.S.C. 2431 et seq.), the President may—
22
(1) determine that such title should no longer
23
apply to Kazakhstan; and

(2) after making a determination under para-

graph (1) with respect to Kazakhstan, proclaim the
2
extension of nondiscriminatory treatment (normal
3
trade relations treatment) to the products of
4
Kazakhstan.

(b) TERMINATION
OF APPLICABILITY
OF TITLE
6
IV.—On and after the date on which the President ex-
7
tends nondiscriminatory treatment to the products of
8
Kazakhstan pursuant to subsection (a), title IV of the
9
Trade Act of 1974 (19 U.S.C. 2431 et seq.) shall cease
10
to apply to Kazakhstan.
