resolution; which was referred to the Committee on the Judiciary

Impeaching Joseph Robinette Biden, President of the United
States, for high crimes and misdemeanors.
Resolved, That Joseph Robinette Biden, President of

the United States, is impeached for high crimes and mis-
2
demeanors and that the following Articles of Impeachment
3
be exhibited to the United States Senate:

Articles of Impeachment exhibited by the House of

Representatives of the United States of America in the
6
name of itself and of the people of the United States of
7
America, against Joseph Robinette Biden, President of the
8
United States of America, in maintenance and support of

ARTICLE I

The Constitution provides that the House of Rep-
4
resentatives ‘‘shall have the sole Power of Impeachment’’
5
and that the President ‘‘shall be removed from Office on
6
Impeachment for, and Conviction of, Treason, Bribery, or
7
other high Crimes and Misdemeanors.’’.
8
In his conduct as President of the United States, in
9
violation of his constitutional oath faithfully to execute the
10
office of the President of the United States, and, to the
11
best of his ability, preserve, protect, and defend, the Con-
12
stitution of the United States, and in violation of his con-
13
stitutional duty to take care that the laws be faithfully
14
executed, Joseph Robinette Biden abused the power of the
15
Office of the President by endangering the security of the
16
United States and thwarting the will of Congress as set
17
forth in duly enacted law, in that:
18
President Biden has allowed aliens to enter the
19
United States in violation of the immigration laws, admit-
20
ted aliens who have tested positive for COVID–19 during
21
the pandemic into the United States, thwarted the will of
22
Congress as set forth in duly enacted law by not com-
23
pleting the southern border wall, and deprived border
24
agents of the sufficient manpower and resources needed
25
to secure the border and its physical infrastructure.

His conduct has included the following:

(1) President Biden’s Department of Homeland
2
Security (hereinafter referred to as ‘‘DHS’’) has
3
willfully refused to maintain operational control of
4
the border as required by the Secure Fence Act of
5
2006. His actions have directly led to an increase in
6
illegal aliens and illegal narcotics, including deadly
7
fentanyl, entering the United States.
8
(2) President Biden’s administration has will-
9
fully violated the Immigration and Nationality Act
10
by releasing illegal aliens into the interior of the
11
United States. The Act clearly requires DHS to de-
12
tain aliens seeking admission to the United States
13
while they are processed. By law, DHS does not
14
have the option to simply release aliens into the inte-
15
rior of the United States.
16
(3) President Biden has reinstituted the catch
17
and release policies of the Obama administration
18
and has released aliens into the interior of the
19
United States without issuing the aliens notices to
20
appear.
21
(4) Under President Biden’s administration,
22
the Department of Homeland Security terminated
23
the Migrant Protection Protocols, which provided a
24
pathway to process claims in compliance with the

law, and served as a deterrent to illegal immigration

and aliens making fraudulent asylum claims.

(5) As a result of President Biden’s policies,
3
Customs and Border Patrol (hereinafter referred to
4
as ‘‘CBP’’) encounters have increased each month
5
since he became President. Since January 2021,
6
over 6,000,000 border crossers have been encoun-
7
tered by CBP personnel or evaded capture.
8
(6) In addition to illegal aliens, President
9
Biden’s policies have led to a significant increase in
10
illegal drug smuggling across the southern border.
11
Fentanyl now kills over 300 Americans every day.
12
President Biden, by these actions, has made the bor-
13
der less secure and encouraged aliens to enter the United
14
States illegally instead of taking actions to maintain oper-
15
ational control of the border. His actions have thwarted
16
the will of Congress as set forth in duly enacted law and
17
the core tenets of the Constitution.
18
Article II of the U.S. Constitution tasks the executive
19
branch—which today includes the DHS—with ensuring
20
the laws passed by Congress and signed into law by the
21
President are faithfully executed. Under President Biden’s
22
administration, the DHS has willfully violated the Immi-
23
gration and Nationality Act. His actions have endangered

duly enacted law, and violated the very rule of law.

Wherefore President Biden, by such conduct, has

demonstrated that he will remain a threat to national se-
4
curity and the Constitution if allowed to remain in office,
5
and has acted in a manner grossly incompatible with the
6
rule of law. President Biden thus warrants impeachment
7
and trial, removal from office, and disqualification to hold
8
and enjoy any office of honor, trust, or profit under the
9
United States.

He enacted border policies that endangered the peo-
1
ple of the United States by allowing illegal aliens who had
2
tested positive for COVID–19 to enter the country and
3
infect American citizens.
4
On March 20, 2020, the Centers for Disease Control
5
and Prevention (hereinafter referred to as ‘‘CDC’’) issued
6
an order, pursuant to sections 362 and 365 of the Public
7
Health Service Act (42 U.S.C. 265 and 268) (hereinafter
8
referred to as ‘‘Title 42’’), suspending the right to intro-
9
duce certain persons into the United States from countries
10
where a quarantinable communicable disease exists. This
11
order has been extended multiple times since it was first
12
issued. According to the CDC, this order is necessary ‘‘to
13
protect the public health from an increase in the serious
14
danger of the introduction of Coronavirus Disease 2019
15
(COVID–19) into the ports of entry, and the Border Pa-
16
trol stations between ports of entry, at or near the United
17
States borders with Canada and Mexico.’’.

The law requires Border Patrol agents and other
19
CBP officers to enforce the order. Despite this require-
20
ment, President Biden’s administration has refused to
21
faithfully implement this order as evidenced by the in-
22
creasing number of aliens processed by CBP under the
23
Immigration and Nationality Act instead of expelled pur-
24
suant Title 42.

If DHS was unable to expel aliens pursuant to Title
1
42, it should not have released aliens into the interior of
2
the United States where they could spread COVID–19.
3
However, instead of detaining aliens as required by law,
4
under President Biden’s leadership DHS released and
5
transported hundreds of thousands of aliens into the inte-
6
rior of the United States without properly screening the
7
aliens for COVID–19 to ensure that the aliens would not
8
spread COVID–19. These actions subjected the American
9
people to unnecessary and avoidable risks.
10
President Biden clearly violated his duties as Presi-
11
dent in failing to enforce our Nation’s immigration laws.
12
He has violated his constitutional oath of office by failing
13
to enforce laws enacted by Congress and by usurping Con-
14
gress’ spending authority. President Biden’s abuse of
15
power has endangered America and the very laws that gov-
16
ern her.

Wherefore President Biden, by such conduct, has
18
demonstrated that he will remain a threat to national se-
19
curity and the Constitution if allowed to remain in office,
20
and has acted in a manner grossly incompatible with the
21
rule of law. President Biden thus warrants impeachment

and paying over $2,000,000,000 in Americans tax dollars

to not build and maintain the wall, President Biden is

breaking his sworn oath as President of the United States

emies.

In each of these actions, President Biden has failed

to enact policies and has created an environment of law-
9
lessness to the manifest injury of the people of the United
10
States.

Wherefore President Biden, by such conduct, has

curity and the Constitution if allowed to remain in office,

and has acted in a manner grossly incompatible with the
15
rule of law. President Biden thus warrants impeachment
