Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. DEPARTMENT OF ENERGY ELECTRIC VEHICLE 1 SHARING SERVICE GRANT PROGRAM. 2 (a) DEFINITIONS.—In this section: 3 (1) CHARGER.—The term ‘‘charger’’ means a 4 device with 1 or more charging ports and connectors 5 for charging electric vehicles. 6 (2) ELECTRIC VEHICLE.—The term ‘‘electric 7 vehicle’’ means a vehicle that derives all of the power 8 of the vehicle from electricity. 9 (3) ELECTRIC VEHICLE SHARING SERVICE.— 10 The term ‘‘electric vehicle sharing service’’ means a 11 service that— 12 (A) allows an individual to apply for a 13 membership that preapproves the individual to 14 rent electric vehicles from the service; and 15 (B) permits preapproved individuals to 16 rent electric vehicles for short periods of time. 17 (4) ELECTRIC VEHICLE SUPPLY EQUIPMENT.— 18 (A) IN GENERAL.—The term ‘‘electric ve- 19 hicle supply equipment’’ means any property, 20 other than a building or a structural component 21 of a building, that is— 22 (i) a charger; 23 (ii) present at the location where elec- 24 tric vehicles are charged; and 25 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3468 IH (iii) available for use by members of 1 the general public. 2 (B) INCLUSION.—The term ‘‘electric vehi- 3 cle supply equipment’’ includes any utility serv- 4 ice connection, or utility panel upgrade, that is 5 required for the charging of electric vehicles. 6 (5) ELIGIBLE ENTITY.—The term ‘‘eligible enti- 7 ty’’ means— 8 (A) a public housing agency; 9 (B) a unit of local government; and 10 (C) a nonprofit organization that has en- 11 tered into an agreement with a public housing 12 agency or unit of local government under which 13 the public housing agency or unit of local gov- 14 ernment agrees to host an electric vehicle shar- 15 ing service on the property of the public hous- 16 ing agency or unit of local government. 17 (6) FAIR LABOR PRACTICES.—The term ‘‘fair 18 labor practices’’ means practices that comply with 19 applicable labor laws and regulations and provide 20 workers with fair wages, safe working conditions, 21 and protections against discrimination, harassment, 22 and exploitation. 23 (7) FINAL ASSEMBLY.—The term ‘‘final assem- 24 bly’’ means the process by which a manufacturer 25 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3468 IH produces a new electric vehicle at, or through the 1 use of, a plant, factory, or other place from which 2 the electric vehicle is delivered to a dealer or im- 3 porter with all component parts necessary for the 4 mechanical operation of the electric vehicle included 5 with the electric vehicle, regardless of whether the 6 component parts are permanently installed in or on 7 the electric vehicle. 8 (8) MAJOR URBAN AREA.—The term ‘‘major 9 urban area’’ means a metropolitan statistical area 10 within the United States with an estimated popu- 11 lation of not less than 1,500,000 residents. 12 (9) NETWORKED DIRECT CURRENT FAST 13 CHARGING EQUIPMENT.— 14 (A) IN GENERAL.—The term ‘‘networked 15 direct current fast charging equipment’’ means 16 electric vehicle charging equipment that— 17 (i) provides a direct current power 18 source at a minimum of 50 kilowatts; and 19 (ii) is enabled to connect to a network 20 to facilitate data collection and access. 21 (B) INCLUSION.—The term ‘‘networked di- 22 rect current fast charging equipment’’ includes 23 a Direct Current Fast Charger. 24 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 3468 IH (10) REGISTERED APPRENTICE.—The term 1 ‘‘registered apprentice’’ means a person partici- 2 pating in a program registered pursuant to the Act 3 of August 16, 1937 (commonly known as the ‘‘Na- 4 tional Apprenticeship Act’’) (50 Stat. 664, chapter 5 663; 29 U.S.C. 50 et seq.). 6 (11) SECRETARY.—The term ‘‘Secretary’’ 7 means the Secretary of Energy. 8 (b) ESTABLISHMENT.—Not later than 1 year after 9 the date of enactment of this Act, the Secretary, in coordi- 10 nation with the Secretary of Transportation and the Sec- 11 retary of Housing and Urban Development, shall carry out 12 a program to award grants, on a competitive basis, to fa- 13 cilitate electric vehicle sharing services operated at public 14 housing projects. 15 (c) APPLICATIONS.—An eligible entity seeking a 16 grant under this section shall submit to the Secretary an 17 application in such form, in such manner, and containing 18 such information as the Secretary determines appropriate. 19 (d) CRITERIA FOR GRANT AWARDS.—In awarding 20 grants under this section, the Secretary shall consider the 21 following criteria: 22 (1) The capacity of an eligible entity to operate 23 a proposed electric vehicle sharing service. 24 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 6 •HR 3468 IH (2) Whether a proposed electric vehicle sharing 1 service would address— 2 (A) the infrastructure needs of the public 3 housing project where that electric vehicle shar- 4 ing service will be operated; and 5 (B) the transportation needs of the com- 6 munity surrounding the public housing project. 7 (3) Whether the eligible entity has developed a 8 culturally competent community engagement and 9 education plan for outreach regarding the proposed 10 electric vehicle sharing service. 11 (4) The economic and operational sustainability 12 of the proposed electric vehicle sharing service. 13 (5) Whether the eligible entity proposes to in- 14 stall networked direct current fast charging equip- 15 ment in connection with the proposed electric vehicle 16 sharing service. 17 (6) Whether the eligible entity proposes to pur- 18 chase electric vehicles with respect to which final as- 19 sembly occurred at a location operating under a col- 20 lective bargaining agreement. 21 (7) Whether the eligible entity proposes to pur- 22 chase electric vehicles that— 23 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 7 •HR 3468 IH (A) with respect to final assembly, are as- 1 sembled using component parts that are at least 2 50 percent domestic content; and 3 (B) are powered by battery cells manufac- 4 tured in the United States. 5 (8) Whether the eligible entity proposes to pur- 6 chase electric vehicles from manufacturers that 7 prioritize fair labor practices and worker protections, 8 as demonstrated through certification programs or 9 publicly available reports on the supply chain prac- 10 tices of the manufacturer. 11 (9) Other criteria as determined appropriate by 12 the Secretary. 13 (e) PRIORITIZATION OF GRANT AWARDS TO 14 MARGINALIZED COMMUNITIES.— 15 (1) IN GENERAL.—In awarding grants under 16 this section, the Secretary shall give priority to eligi- 17 ble entities that serve communities that have been 18 historically marginalized or disproportionately im- 19 pacted by environmental injustice. 20 (2) CRITERIA FOR PRIORITIZATION.—In car- 21 rying out paragraph (1), the Secretary shall consider 22 the extent to which the proposed public housing 23 project— 24 (A) is located in a community that has— 25 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 8 •HR 3468 IH (i) disproportionately high rates of 1 pollution and poor air quality; or 2 (ii) limited access to affordable trans- 3 portation options; and 4 (B) will benefit from an electric vehicle 5 sharing service, especially with respect to ad- 6 dressing transportation needs and reducing 7 greenhouse gas emissions and criteria air pol- 8 lutants. 9 (f) PERMITTED GRANT USES.— 10 (1) IN GENERAL.—An eligible entity awarded a 11 grant under this section may only use grant funds 12 for the following activities to facilitate an electric ve- 13 hicle sharing service operated at a public housing 14 project: 15 (A) The purchase of light-duty electric ve- 16 hicles that are not more than 5 years old. 17 (B) The purchase, installation, and main- 18 tenance of electric vehicle supply equipment. 19 (C) Conducting community education and 20 outreach with respect to the electric vehicle 21 sharing service. 22 (D) Providing incentives for residents of 23 the public housing project to use the electric ve- 24 hicle sharing service, including subsidized fares. 25 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 9 •HR 3468 IH (E) Maintenance, repairs, and other costs 1 associated with operating the electric vehicle 2 sharing service, including towing, impound, and 3 driving infraction fines. 4 (F) Monitoring, data collection, and eval- 5 uation with respect to the electric vehicle shar- 6 ing service. 7 (G) Obtaining technical assistance relating 8 to the establishment, operation, and evaluation 9 of the electric vehicle sharing service. 10 (2) MINIMUM STANDARDS FOR PURCHASED 11 ELECTRIC VEHICLES.—The Secretary shall establish 12 minimum standards relating to functionality and 13 range for electric vehicles eligible to be purchased 14 under paragraph (1)(A). 15 (g) GRANT LIMITATIONS.— 16 (1) AVAILABILITY.—Grant funds awarded 17 under this section to an eligible entity shall be avail- 18 able for obligation or expenditure during the 5-year 19 period beginning on the date on which the grant 20 funds are awarded. 21 (2) MAXIMUM AMOUNT.— 22 (A) IN GENERAL.—Subject to subpara- 23 graph (B), the amount of a grant under this 24 section shall not be more than $1,000,000 for 25 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 10 •HR 3468 IH each public housing project at which the eligible 1 entity receiving the grant will operate an elec- 2 tric vehicle sharing service. 3 (B) NETWORKED DIRECT CURRENT FAST 4 CHARGING EQUIPMENT.—In the case of a public 5 housing project that includes the installation of 6 networked direct current fast charging equip- 7 ment, the maximum amount of a grant under 8 subparagraph (A) may be increased by $50,000 9 per unit of networked direct current fast charg- 10 ing equipment, for not more than 2 units of 11 networked direct current fast charging equip- 12 ment. 13 (h) REPORTS.—As a condition of receiving a grant 14 under this section, an eligible entity shall submit to the 15 Secretary, before the end of each year during which the 16 eligible entity receives grant amounts, a report that— 17 (1) describes the activities carried out with the 18 grant amounts; and 19 (2) includes data on— 20 (A) the operating and capital costs for the 21 electric vehicle sharing service facilitated with 22 those grant amounts; 23 (B) the revenue generated by the electric 24 vehicle sharing service; 3 (D) the number of active users of the elec- 4 tric vehicle sharing service; 5 (E) the distance traveled by the electric ve- 6 hicles of the electric vehicle sharing service; 7 (F) the estimated reduction in greenhouse 8 gas emissions and criteria air pollutants associ- 9 ated with the electric vehicle sharing service; 10 and 11 (G) the results of a survey of customers of 12 the electric vehicle sharing service that provides 13 information on customer preferences, destina- 14 tions, and other information the Secretary de- 15 termines appropriate. 16 (i) LABOR.— 17 (1) CONTRACTS FOR INSTALLATION OF ELEC- 18 TRIC VEHICLE SUPPLY EQUIPMENT.—As a condition 19 of receiving a grant under this section, an eligible 20 entity shall ensure, to the maximum extent prac- 21 ticable, that— 22 (A) not less than 40 percent of the employ- 23 ees of any nongovernmental entity that enters 24 into a contract with the eligible entity, or a sub- 25 VerDate Sep 11 2014 04:45 Jun 09, 2023 Jkt 039200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H3468.IH H3468 kjohnson on DSK79L0C42PROD with BILLS 12 •HR 3468 IH contract thereof, for the installation of electric 1 vehicle supply equipment are— 2 (i) domiciled— 3 (I) if the installation is carried 4 out at a location in a major urban 5 area, not farther than 15 miles from 6 the location of the installation; or 7 (II) if the installation is not car- 8 ried out at a location in a major 9 urban area, not farther than 50 miles 10 from the location of the installation; 11 (ii) members or veterans of the Armed 12 Forces; 13 (iii) displaced and unemployed energy 14 workers; 15 (iv) registered apprentices who have 16 completed less than 15 percent of the re- 17 quired hours for the apprenticeship pro- 18 gram in which the registered apprentices 19 are enr [Text truncated for display.
