Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROHIBITION AGAINST LIMITING, SEGREGATING, 1 OR CLASSIFYING APPLICANTS FOR EMPLOY- 2 MENT. 3 Section 4(a)(2) of the Age Discrimination in Employ- 4 ment Act of 1967 (29 U.S.C. 623(a)(2)) is amended— 5 (1) by inserting ‘‘or applicants for employment’’ 6 after ‘‘employees’’; and 7 (2) by inserting ‘‘or as an applicant for employ- 8 ment’’ after ‘‘employee’’. 9 SEC. 3. STUDY. 10 Not later than 1 year after the date of the enactment 11 of this Act, the Equal Employment Opportunity Commis- 12 sion shall conduct a study to determine the number of 13 claims pending or filed with the Commission since 2015 14 under the Age Discrimination in Employment Act of 1967 15 (29 U.S.C. 621 et seq.), including claims in closed cases, 16 by job applicants who may have been adversely impacted 17 by age discrimination in the job application process.
