A BILL
To require the Secretary of Transportation to modify certain
regulations relating to the requirements for commercial
driver’s license testing and commercial learner’s permit
holders, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Licensing Individual
4
Commercial Exam-takers Now Safely and Efficiently Act
5
of 2023’’ or the ‘‘LICENSE Act of 2023’’.

SEC. 2. MODIFICATIONS TO CERTAIN COMMERCIAL DRIV-

ER’S LICENSE REGULATIONS.

Not later than 90 days after the date of enactment
3
of this Act, the Secretary of Transportation, acting
4
through the Administrator of the Federal Motor Carrier
5
Safety Administration, shall—
6
(1) revise section 384.228 of title 49, Code of
7
Federal Regulations (or a successor regulation), to
8
allow a State or third-party examiner to administer
9
a commercial driver’s license knowledge test if the
10
examiner—
11
(A) maintains a valid commercial driver’s
12
license test examiner certification;
13
(B) completes a commercial driver’s license
14
skills test examiner training course that meets
15
the requirements of subsection (d) of that sec-
16
tion; and
17
(C) completes 1 unit of instruction de-
18
scribed in subsection (c)(3) of that section; and
19
(2) revise section 383.79 of title 49, Code of
20
Federal Regulations (or a successor regulation), to
21
allow a State to administer a driving skills test to
22
any commercial driver’s license applicant, regardless
23
of the State of domicile of the applicant or where the
24
applicant received driver training.
