A BILL
To allow Federal law enforcement officers to purchase retired
service weapons, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Federal Law Enforce-
4
ment Service Weapon Purchase Act’’.

SEC. 2. PURCHASE OF RETIRED HANDGUNS BY FEDERAL
6
LAW ENFORCEMENT OFFICERS.

(a) DEFINITIONS.—In this section:

(1) the term ‘‘Federal law enforcement officer’’
1
has the meaning given the term in section 115(c)(1)
2
of title 18, United States Code;
3
(2) the term ‘‘handgun’’ has the meaning given
4
the term in section 921(a) of title 18, United States
5
Code; and
6
(3) the term ‘‘retired handgun’’ means any
7
handgun that has been declared surplus by the ap-
8
plicable Federal agency.

(b) AUTHORIZATION.—A Federal law enforcement of-
10
ficer may purchase a retired handgun from the Federal
11
agency that issued the handgun to the officer.
12
(c) LIMITATIONS.—A Federal law enforcement officer
13
may purchase a retired handgun under subsection (b) if—
14
(1) the purchase is made during the 6-month
15
period beginning on the date on which the handgun
16
was so retired; and
17
(2) the Federal law enforcement officer is not
18
prohibited from possessing or receiving the handgun
19
under the laws of the United States or the laws of
20
the State, territory, or possession of the United
21
States in which the Federal law enforcement officer
22
resides.

(d) COST.—A handgun purchased under this section

shall be sold at the fair market value for the handgun tak-
2
ing into account the age and condition of the handgun.

(e) POLICY GUIDANCE.—The Administrator of Gen-
4
eral Services shall develop policies to facilitate the sale and
5
disposition of eligible handguns under this section con-
6
sistent with section 922 of title 18, United States Code.
