Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROVIDING FOR COVERAGE OF MONITORING AND 1 ALARM DEVICES TO DETECT VENOUS NEE- 2 DLE DISLODGEMENT FOR HEMODIALYSIS PA- 3 TIENTS. 4 Section 1881(b)(14) of the Social Security Act (42 5 U.S.C. 1395rr(b)(14)) is amended by adding at the end 6 the following new subparagraph: 7 ‘‘(J)(i) For home dialysis services and equipment fur- 8 nished to new and respite individuals on or after the date 9 that is 1 year after the date of the enactment of this sub- 10 paragraph which are monitoring and alarm devices for ve- 11 nous needle dislodgement (as defined in clause (iii)(II)), 12 the Secretary shall increase the single payment that would 13 otherwise apply under this paragraph for such services by 14 the amount determined under the payment system estab- 15 lished under clause (ii). 16 ‘‘(ii) The Secretary shall establish a prospective pay- 17 ment system through regulations to determine the 18 amounts payable for monitoring and alarm devices and 19 supplies to detect venous needle dislodgements for individ- 20 uals receiving home dialysis. In establishing such system, 21 the Secretary may consult with device manufacturers, 22 health professionals, dialysis patients, private payers, and 23 MA plans and may consider— 24 ‘‘(I) the costs of furnishing the monitoring and 25 alarm device and necessary supplies; 26 VerDate Sep 11 2014 05:28 May 19, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3118.IH H3118 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3118 IH ‘‘(II) payment amounts for similar items and 1 services under parts A and B; and 2 ‘‘(III) payment amounts established by MA 3 plans under part C, group health plans, and health 4 insurance coverage offered by health insurance 5 issuers. 6 ‘‘(iii) In this subparagraph: 7 ‘‘(I) The term ‘new and respite individual’ 8 means an individual described in subsection (a) who 9 is initiating home hemodialysis. 10 ‘‘(II) The term ‘monitoring and alarm devices 11 for venous needle dislodgement’ means a blood loss 12 detection solution specifically designed to detect 13 blood leakage through core technology utilizing fiber 14 optics.
