SHORT TITLE. 3 This Act may be cited as the ‘‘Bottles and 4 Breastfeeding Equipment Screening Enhancement Act’’. 5 SEC. 2. HYGIENIC HANDLING OF BREAST MILK AND BABY 6 FORMULA DURING AVIATION SECURITY 7 SCREENING. 8 The Bottles and Breastfeeding Equipment Screening 9 Act (Public Law 114–293) is amended by adding at the 10 end the following new sections: 11 ‘‘SEC. 3. HYGIENIC HANDLING OF BREAST MILK AND BABY 12 FORMULA DURING AVIATION SECURITY 13 SCREENING. 14 ‘‘Not later than 90 days after the date of the enact- 15 ment of this section and every five years thereafter, if ap- 16 propriate, the Administrator of the Transportation Secu- 17 rity Administration shall issue or update, as the case may 18 be, guidance to minimize the risk for contamination of any 19 breast milk, baby formula, purified deionized water for in- 20 fants, and juice (as well as ice packs, freezer packs, frozen 21 gel packs and other accessories required to cool breast 22 milk, baby formula, and juice) that is subject to re-screen- 23 ing or otherwise subject to additional screening. Such 24 guidance shall— 25 3 † S 1570 ES ‘‘(1) be developed in consultation with nation- 1 ally recognized maternal health organizations; 2 ‘‘(2) ensure adherence to hygienic standards, as 3 established by the Administrator, in consultation 4 with nationally recognized maternal health organiza- 5 tions; 6 ‘‘(3) ensure that, when any such re-screening or 7 additional screening requires additional testing, such 8 testing so adheres to such standards, to so minimize 9 such risk; and 10 ‘‘(4) apply to security screening personnel of 11 the Administration and personnel of private security 12 companies providing security screening pursuant to 13 section 44920 of title 49, United States Code. 14 ‘‘SEC. 4. INSPECTOR GENERAL AUDIT. 15 ‘‘Not later than one year after the date of the enact- 16 ment of this section, the Inspector General of the Depart- 17 ment of Homeland Security shall submit to the Committee 18 on Homeland Security of the House of Representatives 19 and the Committee on Commerce, Science, and Transpor- 20 tation of the Senate a report containing an audit of com- 21 pliance with the requirements of sections 2 and 3. Such 22 audit shall also include information relating to the effect 23 of various types of screening technologies, including bot- 24 tled liquid scanners, on the screening of breast milk, baby 25 4 † S 1570 ES formula, purified deionized water for infants, and juice (as 1 well as ice packs, freezer packs, frozen gel packs and other 2 accessories required to cool breast milk, baby formula, and 3 juice) that is subject to re-screening or otherwise subject 4 to additional screening, and the rate at which such items 5 are denied entry into the sterile area (as such term is de- 6 fined in section 1540.5 of title 49, Code of Federal Regu- 7 lations).’’. 8 Passed the Senate September 25, 2024.
