A BILL
To amend the Victims of Crime Act of 1984 with respect
to crime victim compensation program eligibility, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Justice for Victims
4
of Open Borders Act of 2023’’.
5
SEC. 2. CRIME VICTIM COMPENSATION.
6
Section 1403(b) of the Victims of Crime Act of 1984
7
(34 U.S.C. 20102) is amended—
8
(1) in paragraph (1), by striking ‘‘is operated
9
by a State and’’;

(2) by redesignating paragraphs (2) through
1
(10) as paragraphs (4) though (12), respectively;
2
and
3
(3) by inserting after paragraph (1) the fol-
4
lowing:

‘‘(2) such program is operated by a State for
6
which the State’s Attorney General has certified to
7
the Attorney General that the program—
8
‘‘(A) prioritizes making payments to vic-
9
tims of crimes committed by an alien who was
10
unlawfully present in the United States at the
11
time of the commission of the crime; and
12
‘‘(B) does not prioritize making payments
13
to victims of crimes committed by a person
14
whose status under the immigration laws (as
15
such term is defined in section 101 of the Im-
16
migration and Nationality Act) is unknown;
17
‘‘(3) such program does not provide compensa-
18
tion to any alien unlawfully present in the United
19
States;’’.
