To amend title 49, United States Code, to establish an
Aviation Security Checkpoint Technology Fund in the
Department of Homeland Security to fund investments
in aviation security checkpoint technology, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Aviation Security
4
Checkpoint Technology Fund Act of 2023’’.

SEC. 2. ESTABLISHMENT OF AVIATION SECURITY CHECK-

POINT TECHNOLOGY FUND.

Section 44923 of title 49, United States Code, is
3
amended—
4
(1) by redesignating subsection (i) as subsection
5
(j); and
6
(2) by inserting after subsection (h) the fol-
7
lowing new subsection:
8
‘‘(i) AVIATION SECURITY CHECKPOINT TECHNOLOGY
9
FUND.—
10
‘‘(1) IN GENERAL.—There is established within
11
the Department of Homeland Security a fund to be
12
known as the Aviation Security Checkpoint Tech-
13
nology Fund (in this subsection referred to as the
14
‘ASCT Fund’). The second $250,000,000 from fees
15
received under section 44940(a)(1) in each of fiscal
16
years 2024 through 2028 shall be available to be de-
17
posited in the ASCT Fund. The Administrator of
18
the Transportation Security Administration shall im-
19
pose the fee authorized by section 44940(a)(1) so as
20
to collect not less than $250,000,000 in each of such
21
fiscal years for deposit into the ASCT Fund.
22
Amounts in the ASCT Fund shall be available until
23
expended to the Administrator of the Transportation
24
Security Administration to fund the procurement,

deployment, and sustainment of aviation security

checkpoint technology.

‘‘(2) TSA BRIEFING.—Not later than 180 days
3
after the date of the enactment of this subsection
4
and quarterly thereafter for five years, the Adminis-
5
trator of the Transportation Security Administration
6
shall brief the Committee on Homeland Security and
7
the Committee on Appropriations of the House of
8
Representatives and the Committee on Commerce,
9
Science, and Transportation and the Committee on
10
Appropriations of the Senate regarding planned pro-
11
curement, nationwide deployment, and sustainment
12
efforts of aviation security checkpoint technology at
13
airport checkpoints through amounts made available
14
from the ASCT Fund.’’.
