Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Curbing Realistic Ex- 4 ploitative Electronic Pedophilic Robots Act 2.0’’ or as the 5 ‘‘CREEPER Act 2.0’’. 6 SEC. 2. FINDINGS. 7 The Congress finds as follows: 8 VerDate Sep 11 2014 04:43 May 04, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2877.IH H2877 pbinns on DSKJLVW7X2PROD with $$_JOB 2 •HR 2877 IH (1) There is a correlation between possession of 1 the obscene dolls, and robots, and possession of and 2 participation in child pornography. 3 (2) The physical features, and potentially the 4 ‘‘personalities’’ of the robots are customizable or 5 morphable and can resemble actual children. 6 (3) Some owners and makers of the robots have 7 made their children interact with the robots as if the 8 robots are members of the family. 9 (4) The robots can have settings that simulate 10 rape. 11 (5) The dolls and robots not only lead to rape, 12 but they make rape easier by teaching the rapist 13 about how to overcome resistance and subdue the 14 victim. 15 (6) For users and children exposed to their use, 16 the dolls and robots normalize submissiveness and 17 normalize sex between adults and minors. 18 (7) As the Supreme Court has recognized, ob- 19 scene material is often used as part of a method of 20 seducing child victims. 21 (8) The dolls and robots are intrinsically related 22 to abuse of minors, and they cause the exploitation, 23 objectification, abuse, and rape of minors. 24 VerDate Sep 11 2014 04:43 May 04, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2877.IH H2877 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •HR 2877 IH SEC. 3. PROHIBITION OF IMPORTATION OR TRANSPORTA- 1 TION OF CHILD SEX DOLLS. 2 Section 1462 of title 18, United States Code, is 3 amended— 4 (1) in paragraph (a), by striking ‘‘or’’ at the 5 end; 6 (2) in paragraph (b), by striking ‘‘or’’ at the 7 end; 8 (3) by inserting after paragraph (c) the fol- 9 lowing: 10 ‘‘(d) any child sex doll; or’’; and 11 (4) by adding at the end the following: 12 ‘‘In this section, the term ‘child sex doll’ means an ana- 13 tomically correct doll, mannequin, or robot, with the fea- 14 tures of, or with features that resemble those of, a minor, 15 intended for use in sexual acts.’’. 16 SEC. 4. TRAFFICKING IN CHILD SEX DOLLS. 17 (a) IN GENERAL.—Chapter 71 of title 18, United 18 States Code, is amended by adding at the end the fol- 19 lowing: 20 ‘‘§ 1471. Trafficking in child sex dolls 21 ‘‘Whoever knowingly— 22 ‘‘(1) buys, sells, delivers, or distributes in inter- 23 state or foreign commerce any child sex doll, 24 ‘‘(2) possesses a child sex doll that has been so 25 bought, sold, delivered, or distributed, or 26 VerDate Sep 11 2014 04:43 May 04, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2877.IH H2877 pbinns on DSKJLVW7X2PROD with $$_JOB 4 •HR 2877 IH ‘‘(3) possesses such a child sex doll with the in- 1 tent to engage in any conduct prohibited by para- 2 graph (1), 3 shall be fined under this title or imprisoned not more than 4 five years, or both, for the first such offense and shall be 5 fined under this title or imprisoned not more than ten 6 years, or both, for each such offense thereafter. For pur- 7 poses of this section, the term ‘child sex doll’ has the 8 meaning given such term in section 1462.’’. 9 (b) CLERICAL AMENDMENT.—The table of sections 10 for such chapter is amended by adding at the end the fol- 11 lowing: 12 ‘‘1471.
