To amend the Higher Education Act of 1965 to increase the Federal student
loan limits for students in flight education and training programs.

Ms. BALDWIN (for herself and Mr. SULLIVAN) introduced the following bill;
which was read twice and referred to the Committee on Health, Edu-
cation, Labor, and Pensions
A BILL
To amend the Higher Education Act of 1965 to increase
the Federal student loan limits for students in flight
education and training programs.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Flight Education Ac-
4
cess Act’’.

SEC. 2. INCREASE IN FEDERAL STUDENT LOAN LIMITS FOR
1
STUDENTS
IN
FLIGHT
EDUCATION
AND
2
TRAINING PROGRAMS.

Section 455 of the Higher Education Act of 1965 (20
4
U.S.C. 1087e) is amended—
5
(1) in subsection (p)—
6
(A) by striking ‘‘Each institution’’ and in-
7
serting the following:
8
‘‘(1) IN GENERAL.—Each institution’’;
9
(B) in paragraph (1) (as designated by
10
subparagraph (A)), by inserting before the pe-
11
riod at the end the following: ‘‘and, shall, with
12
respect to Federal Direct Stafford Loans and
13
Federal Direct Unsubsidized Stafford Loans
14
made after the date of enactment of the Flight
15
Education Access Act to an eligible student (as
16
defined in subsection (r)), comply with the re-
17
quirements of paragraph (2)’’; and
18
(C) by adding at the end the following:
19
‘‘(2) ADDITIONAL DISCLOSURES.—At or prior
20
to the disbursement of a Federal Direct Stafford
21
Loan or Federal Direct Unsubsidized Stafford Loan
22
after the date of enactment of the Flight Education
23
Access Act to an eligible student (as defined in sub-
24
section (r)), the following shall be disclosed:

‘‘(A) The principal amount of the loan, the
1
stated interest rate on the loan, the number of
2
required monthly payments to be made on the
3
loan (which shall be based on a standard repay-
4
ment plan), and the estimated number of
5
months before the start of the repayment period
6
for the loan (based on the expected date on
7
which the repayment period is to begin or the
8
deferment period is to end, as applicable).
9
‘‘(B) The estimated balance to be owed by
10
the borrower on such loan (including, if applica-
11
ble, the estimated amount of interest to be cap-
12
italized) as of the scheduled date on which the
13
repayment period is to begin or the deferment
14
period is to end, as applicable, and an estimate
15
of the projected monthly payment.
16
‘‘(C) An estimate of the aggregate amount
17
the borrower will pay for the loan, including the
18
total amount of monthly payments made over
19
the life of the loan plus the amount of any
20
charges for the loan, such as an origination
21
fee.’’; and
22
(2) by adding at the end the following:
23
‘‘(r) INCREASE IN LOAN LIMITS FOR STUDENTS IN
24
FLIGHT EDUCATION AND TRAINING PROGRAMS.—

‘‘(1) IN GENERAL.—Notwithstanding any other
1
provision of this Act, the loan limits for Federal Di-
2
rect Stafford Loans and Federal Direct Unsub-
3
sidized Stafford Loans made after the date of enact-
4
ment of the Flight Education Access Act with re-
5
spect to eligible students shall be subject to this sub-
6
section.
7
‘‘(2) DEFINITIONS.—In this section:
8
‘‘(A) ELIGIBLE STUDENT.—The term ‘eli-
9
gible student’ means a student who is enrolled
10
in an eligible undergraduate flight education
11
and training program.

‘‘(B) ELIGIBLE UNDERGRADUATE FLIGHT
13
EDUCATION
AND
TRAINING
PROGRAM.—The
14
term ‘eligible undergraduate flight education
15
and training program’ means an undergraduate
16
flight education and training program that of-
17
fers training for applicants seeking a commer-
18
cial pilot certificate and—
19
‘‘(i) during the period beginning on
20
the date of enactment of the Flight Edu-
21
cation Access Act and ending on the date
22
on which 3 years of data has been collected
23
pursuant to paragraph (3)(D), that meets

all the applicable requirements of this Act;
1
and
2
‘‘(ii) beginning on the date on which
3
3 years of data has been collected pursuant
4
to paragraph (3)(D), that meets all the ap-
5
plicable requirements of this Act and has
6
a completion rate averaged over a 3-year
7
period, as calculated under paragraph
8
(3)(D) that is equal to or greater than 70
9
percent.

‘‘(C)
UNDERGRADUATE
FLIGHT
EDU-
11
CATION
AND
TRAINING
PROGRAM.—The term
12
‘undergraduate flight education and training
13
program’—
14
‘‘(i) has the meaning given the term
15
by the Secretary, in consultation with the
16
Administrator of the Federal Aviation Ad-
17
ministration;
18
‘‘(ii) shall include a flight education
19
and training program offered by an eligible
20
institution that is accredited by an accred-
21
iting agency recognized by the Secretary,
22
that—

‘‘(I) awards undergraduate cer-
1
tificates or associate or bachelor de-
2
grees; and
3
‘‘(II) provides pilot training in
4
accordance with part 141 of title 14,
5
Code of Federal Regulations, or any
6
successor regulation; and
7
‘‘(iii) shall not include a flight edu-
8
cation and training program certified
9
under part 61 of title 14, Code of Federal
10
Regulations, or any successor regulation.

‘‘(3) LOAN
LIMITS
FOR

WHO ARE DEPENDENT STUDENTS.—

‘‘(i) ANNUAL LIMITS.—The maximum
17
annual amount of Federal Direct Unsub-
18
sidized Stafford Loans an eligible student
19
who is a dependent student may borrow in
20
any academic year (as defined in section
21
481(a)(2)) or its equivalent shall be—
22
‘‘(I) in the case of an eligible stu-
23
dent at an eligible institution who has
24
not successfully completed the first

maximum annual loan amount

that such student may receive
12
may not exceed the amount that
13
bears the same ratio to the
14
amount specified in item (aa) as
15
the length of such program meas-
16
ured in semester, trimester, quar-
17
ter, or clock hours bears to one
18
academic year;
19
‘‘(II) in the case of an eligible
20
student at an eligible institution who
21
has successfully completed the first
22
year of an eligible undergraduate
23
flight education and training program

‘‘(aa) $32,500; or

‘‘(ii) AGGREGATE LIMITS.—The max-

imum aggregate amount of Federal Direct
10
Unsubsidized Stafford Loans an eligible
11
student who is a dependent student may
12
borrow shall be $111,000.

STUDENTS

WHO ARE INDEPENDENT STUDENTS.—

‘‘(i) ANNUAL LIMITS.—The maximum
16
annual amount of Federal Direct Unsub-
17
sidized Stafford Loans an eligible student
18
who is an independent student may borrow
19
in any academic year (as defined in section
20
481(a)(2)) or its equivalent shall be—
21
‘‘(I) in the case of an eligible stu-
22
dent at an eligible institution who has
23
not successfully completed the first
24
year of an eligible undergraduate

annual amount of Federal Direct Stafford
14
Loans an eligible student may borrow in
15
any academic year (as defined in section
16
481(a)(2)) or its equivalent shall, subject
17
to subsection (q)(1), be—
18
‘‘(I) in the case of an eligible stu-
19
dent at an eligible institution who has
20
not successfully completed the first
21
year of an eligible undergraduate
