To provide for payment rates for durable medical equipment
under the Medicare program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Competitive Bidding
4
Relief Act of 2023’’.
5
SEC. 2. PAYMENT RATES FOR DURABLE MEDICAL EQUIP-
6
MENT UNDER THE MEDICARE PROGRAM.

(a) AREAS OTHER THAN RURAL AND NONCONTIG-
8
UOUS AREAS.—The Secretary shall implement section
9
414.210(g)(9)(v) of title 42, Code of Federal Regulations

(or any successor regulation), to apply the transition rule
1
described in the first sentence of such section to all appli-
2
cable items and services furnished in areas other than
3
rural or noncontiguous areas (as such terms are defined
4
for purposes of such section) through December 31, 2024.

(b) ALL AREAS.—The Secretary shall not implement
6
section 414.210(g)(9)(vi) of title 42, Code of Federal Reg-
7
ulations (or any successor regulation) until January 1,
8
2025.

(c) IMPLEMENTATION.—Notwithstanding any other
10
provision of law, the Secretary may implement the provi-
11
sions of this section by program instruction or otherwise.
