To amend the Consolidated Farm and Rural Development
Act to modify provisions relating to rural decentralized
water systems grants.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. RURAL DECENTRALIZED WATER SYSTEMS
3
GRANT PROGRAM MODIFICATIONS.

Section 306E of the Consolidated Farm and Rural
5
Development Act (7 U.S.C. 1926e) is amended—
6
(1) by striking the section designation and
7
heading and all that follows through the end of sub-
8
section (b)(1) and inserting the following:

WATER

WELL SYSTEMS AND HOUSEHOLD DECEN-

TRALIZED WASTEWATER SYSTEMS IN RURAL
6
AREAS.

‘‘(a) GRANTS TO NONPROFIT ORGANIZATIONS.—The
8
Secretary may provide grants to private nonprofit organi-
9
zations for the purpose of providing subgrants and loans
10
in accordance with subsection (b) to individuals for the
11
construction, refurbishing, and servicing of individual
12
household water well systems and individually owned
13
household decentralized wastewater systems in rural areas
14
that are or will be owned by the individuals.

‘‘(b) LOANS AND SUBGRANTS TO INDIVIDUALS.—
16
‘‘(1) IN
GENERAL.—A nonprofit organization
17
shall use grant amounts received under subsection
18
(a) to provide—
19
‘‘(A) subgrants for use in accordance with
20
this section to individuals residing in the service
21
area of the nonprofit organization who are
22
members of a household with a combined in-
23
come (for the most recent 12-month period for
24
which the information is available) that is less
25
than 60 percent of the median nonmetropolitan
26

household income for the area, according to the
1
most recent decennial census; and
2
‘‘(B) loans for use in accordance with this
3
section to individuals residing in the service
4
area of the nonprofit organization who are
5
members of a household with a combined in-
6
come (for the most recent 12-month period for
7
which the information is available) that is 60
8
percent or more of the median nonmetropolitan
9
household income for the area, according to the
10
most recent decennial census.’’;

(2) in subsection (b)—
12
(A) in paragraph (2)(B), by striking
13
‘‘$15,000’’ and inserting ‘‘$20,000’’; and
14
(B) by adding at the end the following:

‘‘(5) FUNDING TO COVER COST OF PERFORM-
16
ANCE WARRANTIES.—A subgrant provided to an in-
17
dividual under this subsection for an individually
18
owned household decentralized wastewater system
19
may include sufficient additional funding to cover
20
the cost of a performance warranty with a duration
21
of at least 5 years.’’; and
22
(3) in subsection (d), by striking ‘‘2023’’ and
23
inserting ‘‘2028’’.
