To extend Federal recognition to the Nor Rel Muk Wintu
Nation, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Nor Rel Muk Wintu
4
Nation Federal Recognition Act’’.
5
SEC. 2. FEDERAL RECOGNITION.
6
(a) DEFINITIONS.—In this Act:
7
(1) GOVERNING DOCUMENT.—The term ‘‘gov-
8
erning document’’ means the Constitution of the

September 19, 2020 (and successor documents).

(2) SECRETARY.—The term ‘‘Secretary’’ means
3
the Secretary of the Interior.
4
(3) TRIBAL MEMBER.—The term ‘‘Tribal mem-
5
ber’’ means—
6
(A) an individual who is an enrolled mem-
7
ber of the Tribe as of the date of the enactment
8
of this Act; or
9
(B) an individual who has been placed on
10
the membership rolls of the Tribe in accordance
11
with this Act.

(4) TRIBE.—The term ‘‘Tribe’’ means the Nor
13
Rel Muk Wintu Nation.

(b) FEDERAL RECOGNITION.—
15
(1) IN
GENERAL.—Federal recognition is ex-
16
tended to the Tribe.
17
(2) APPLICABILITY OF LAWS.—All laws (includ-
18
ing regulations) of the United States of general ap-
19
plicability to Indians or nations, Indian Tribes, or
20
bands of Indians (including the Act of June 18,
21
1934 (25 U.S.C. 5101 et seq.)) that are not incon-
22
sistent with this Act shall be applicable to the Tribe
23
and Tribal members.

(3) FEDERAL SERVICES AND BENEFITS.—

(A) IN GENERAL.—On and after the date
1
of the enactment of this Act, the Tribe and
2
Tribal members shall be eligible for all services
3
and benefits provided by the Federal Govern-
4
ment to federally recognized Indian Tribes
5
without regard to—
6
(i) the existence of a reservation for
7
the Tribe; or
8
(ii) the location of the residence of
9
any Tribal member on or near any Indian
10
reservation.
11
(B) SERVICE AREA.—For the purpose of
12
the delivery of Federal services to Tribal mem-
13
bers, the service area of the Tribe shall be con-
14
sidered to be Trinity County, California.
15
(c) MEMBERSHIP.—
16
(1) IN GENERAL.—As a condition of receiving
17
recognition, services, and benefits pursuant to this
18
Act, the Tribe shall submit to the Secretary, by not
19
later than 18 months after the date of the enact-
20
ment of this Act, a membership roll consisting of the
21
name of each individual enrolled as a Tribal mem-
22
ber.

(2) DETERMINATION
OF
MEMBERSHIP.—The
24
qualifications for inclusion on the membership roll of

the Tribe shall be determined in accordance with the

governing document.

(3) MAINTENANCE OF ROLL.—The Tribe shall
3
have the sole authority and responsibility to main-
4
tain the membership roll consistent with the gov-
5
erning document.

(d) GOVERNING BODY.—The governing body of the
7
Tribe shall be—
8
(1) the governing body of the Tribe on the date
9
of enactment of this Act, consistent with the gov-
10
erning document; or
11
(2) any subsequent governing body elected in
12
accordance with the election procedures specified in
13
the governing document.
14
(e) TREATY AND RESERVED RIGHTS.—Nothing in
15
this Act expands, reduces, or in any manner affects any
16
treaty rights or reserved rights of the Tribe.
