Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Toxic Health Threat
4
Warning Act of 2023’’.

SEC. 2. RELEASES OF WATER CONTAMINATED WITH

CYANOTOXINS.

(a) DETERMINATION.—Before any planned release of
3
water from a flood risk management structure, the Sec-
4
retary shall determine whether the water is contaminated
5
with cyanotoxins, based on tests conducted by the Sec-
6
retary, another Federal agency, or the State in which the
7
flood risk management structure is located.

(b) NOTIFICATION.—If the Secretary determines
9
under subsection (a) that water to be released from a flood
10
risk management structure contains cyanotoxins at levels
11
greater than 8 parts-per-billion, the Secretary shall notify
12
the public and affected governments of the determination
13
and planned release, and any potential effects on human
14
health, before releasing the water.

(c) DEFINITIONS.—In this section:
16
(1) AFFECTED GOVERNMENT.—The term ‘‘af-
17
fected government’’ means a State, local, or Tribal
18
government with jurisdiction over an area that will
19
be affected by a release of water from a flood risk
20
management structure.
21
(2) SECRETARY.—The term ‘‘Secretary’’ means
22
the Secretary of the Army, acting through the Chief
23
of Engineers.
