What This Bill Does
This bill directs the Secretary of State to revoke visas from and restrict entry to the United States for certain individuals connected to governments in Venezuela, Cuba, Nicaragua, and Bolivia. The bill also applies these restrictions to spouses and children of those individuals.

- Members of the Sandinista party in Nicaragua
- People who act on behalf of, aid in repression by, or assist the named regimes

Key Provisions
- The Secretary of State must revoke visas or impose restrictions on individuals who committed human rights violations in Venezuela, Cuba, Nicaragua, or Bolivia, or who undermined the democracy or sovereignty of these countries (Sec. 2(a)(1)(A))
- The Secretary must also target people already identified under drug trafficking laws or existing executive orders related to these countries (Sec. 2(a)(2)(A))
- Spouses and children of targeted individuals are subject to the same visa restrictions (Sec. 2(a)(1)(B) and (2)(B))
- Restricted individuals cannot enter the United States, cannot receive visas, and their existing visas will be revoked immediately (Sec. 2(c)(1))
- The Secretary of State must make individual decisions about people who want to visit United Nations headquarters in New York, consulting with the Director of National Intelligence, Attorney General, and Secretary of Homeland Security (Sec. 2(c)(2))
What Changes
If this becomes law, people from Venezuela, Cuba, Nicaragua, and Bolivia meeting the criteria described will not be allowed to enter the United States. Those with existing visas will have them canceled. Government agencies will gain authority to exclude and remove these individuals through expedited removal procedures (a faster process than standard removal).

SEC. 2. VISA RESTRICTIONS FOR CERTAIN VENEZUELANS,

CUBANS, NICARAGUANS, AND BOLIVIANS.

(a) IN GENERAL.—The Secretary of State shall re-
3
voke the visa of, or impose visa restrictions on any indi-
4
vidual described in subsection (b) who the Secretary deter-
5
mines—
6
(1)(A) is responsible for, is complicit in, is re-
7
sponsible for ordering, controlling, or otherwise di-
8
recting, or is knowingly—
9
(i) committing human rights viola-
10
tions at any time in Venezuela, Cuba,
11
Nicaragua, or Bolivia; or
12
(ii) participating in (directly or indi-
13
rectly) any activity in or in relation to Ven-
14
ezuela, Cuba, Nicaragua, or Bolivia at any
15
time that undermines or threatens the in-
16
tegrity of the democracy or sovereignty of,
17
the people of Cuba, Venezuela, Nicaragua,
18
or Bolivia; or
19
(B) is the spouse or child of a foreign person
20
described in subparagraph (A); or
21
(2)(A) is described in or identified under—
22
(i) section 804(b) of the Foreign Narcotics
23
Kingpin Designation Act (21 U.S.C. 1903(b));
24
(ii) Executive Order 13850 (83 Fed. Reg.
25
55243; relating to blocking property of addi-

tional persons contributing to the situation in

Venezuela); or
2
(iii) Executive Order 13884 (84 Fed. Reg.
3
38843; relating to blocking property of the Gov-
4
ernment of Venezuela); or
5
(B) is the spouse or child of a foreign person
6
described in subparagraph (A).

(b) INDIVIDUAL
DESCRIBED.—An individual de-
8
scribed in this subsection is any foreign person, located
9
in the United States or abroad, who—
10
(1) with respect to Venezuela, is—
11
(A) a former official of the Hugo Chavez
12
regime; or
13
(B) a current or former official of the
14
Nicolas Maduro regime;
15
(2) with respect to Cuba, is—
16
(A) a former official of the Fidel Castro or
17
Raul Castro regime; or
18
(B) a current or former official of the
19
Miguel Diaz-Canel regime;
20
(3) with respect to Nicaragua, is—
21
(A) a current or former official of the Dan-
22
iel Ortega regime; or
23
(B) a Sandinista party member;

(4) with respect to Bolivia, is a former official
1
of the Evo Morales regime;
2
(5) acts on behalf of a regime or party de-
3
scribed in any of paragraphs (1) through (4);
4
(6) aids in repression by such regime or party;
5
or
6
(7) assists such regime or party.

(c) VISA RESTRICTIONS DESCRIBED.—
8
(1) EXCLUSION
FROM
THE
UNITED
STATES
9
AND REVOCATION OF VISA OR OTHER DOCUMENTA-
10
TION.—An individual described in subsection (b)—
11
(A) is inadmissible to the United States;
12
(B) is ineligible to receive a visa or other
13
documentation
authorizing
entry
into
the
14
United States;
15
(C) is otherwise ineligible to be admitted or
16
paroled into the United States or to receive any
17
benefit under the Immigration and Nationality
18
Act (8 U.S.C. 1101 et seq.); and
19
(D) shall—
20
(i) in accordance with section 221(i)
21
of the Immigration and Nationality Act (8
22
U.S.C. 1201(i)), have his or her visa or
23
other documentation revoked, regardless of

when the visa or other documentation was
1
issued; and
2
(ii) be subject to expedited removal.

(2) APPLICABILITY FOR INDIVIDUALS VISITING
4
UNITED NATIONS HEADQUARTERS.—In the case of
5
an individual described in subsection (b) who intends
6
to travel to the United States to visit the head-
7
quarters of the United Nations, the Secretary of
8
State, in consultation with the Director of National
9
Intelligence, the Attorney General, and the Secretary
10
of Homeland Security, shall make a case-by-case de-
11
termination with respect to the applicability of sub-
12
section (a) to such individual.
13
(d) RULEMAKING.—The President shall issue such
14
regulations, licenses, and orders as may be necessary to
15
carry out this section.
