Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Twentynine Palms 4 Outdoor Recreational Enhancement Act’’. 5 SEC. 2. CONVEYANCE FOR CITY OF TWENTYNINE PALMS. 6 (a) DEFINITIONS.—In this section: 7 (1) CITY.—The term ‘‘City’’ means the city of 8 Twentynine Palms, California. 9 (2) SECRETARY.—The term ‘‘Secretary’’ means 10 the Secretary of the Interior. 11 VerDate Sep 11 2014 04:58 Dec 14, 2020 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H8848.IH H8848 pbinns on DSKJLVW7X2PROD with BILLS 2 •HR 8848 IH (b) CONVEYANCE OF FEDERAL LAND TO CITY.— 1 (1) CONVEYANCE REQUIRED.—At the request 2 of the city of Twentynine Palms, California, not 3 later than 5 years after the date of the enactment 4 of this Act, the Secretary shall convey to the City, 5 without consideration, all right, title, and interest of 6 the United States in and to the surface estate of the 7 land generally as ‘‘Proposed Conveyance to 8 Twentynine Palms’’ on the map entitled ‘‘Proposed 9 Conveyance to Twentynine Palms’’ and dated Sep- 10 tember 18, 2015. 11 (2) EXISTING RIGHTS AND MINERAL ESTATE.— 12 The conveyance under this subsection— 13 (A) is subject to valid existing rights; and 14 (B) does not include the mineral estate. 15 (c) USE OF CONVEYED LAND.— 16 (1) IN GENERAL.—The land conveyed under 17 subsection (b) may be used by the City for any pub- 18 lic purpose authorized in paragraph (2), consistent 19 with the Act of June 14, 1926 (commonly known as 20 the Recreation and Public Purposes Act; 43 U.S.C. 21 869 et seq.). 22 (2) AUTHORIZED PURPOSES.—The purposes of 23 the conveyance under subsection (b) are to permit 24 the City to use the conveyed land to provide— 25 VerDate Sep 11 2014 04:58 Dec 14, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8848.IH H8848 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 8848 IH (A) a suitable location for the establish- 1 ment of a centralized off-road vehicle recreation 2 park; 3 (B) the public with opportunities for off- 4 road vehicle recreation, including a location for 5 races, competitive events, training, and other 6 commercial services that directly support a cen- 7 tralized off-road vehicle recreation area and 8 City park; and 9 (C) a designated area and facilities that 10 would discourage unauthorized use of off-high- 11 way vehicles in areas that have been identified 12 by the Federal Government, the State of Cali- 13 fornia, or the County of San Bernardino as 14 containing environmentally sensitive land. 15 (3) DISPOSAL PROHIBITED.—The land con- 16 veyed under subsection (b) may not be disposed of 17 by the City without the approval of the Secretary of 18 the Interior. 19 (d) TEMPORARY REVERSIONARY INTEREST.—During 20 the 5-year period beginning on the date of the conveyance 21 of the land under subsection (b), if the Secretary of the 22 Interior determines that the City has disposed of the con- 23 veyed land in violation of subsection (c)(3) or has failed 24 to use the land for the authorized purposes laid out in 25 VerDate Sep 11 2014 04:58 Dec 14, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8848.IH H8848 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 8848 IH subsection (c)(2), title to the land shall revert to the 1 United States, at the option of the Secretary.
