A BILL
To amend title XIX of the Social Security Act to prohibit
estate recovery from certain expansion individuals under
the Medicaid program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Housing And Medicaid
4
Legislation for Expansion Targets Act’’ or the ‘‘HAMLET
5
Act’’.

SEC. 2. PROHIBITING ESTATE RECOVERY FROM CERTAIN

EXPANSION INDIVIDUALS UNDER THE MED-
2
ICAID PROGRAM.

Section 1917 of the Social Security Act (42 U.S.C.
4
1396p) is amended by adding at the end the following new
5
subsection:
6
‘‘(i) PROHIBITION
ON ESTATE RECOVERY FROM
7
CERTAIN EXPANSION INDIVIDUALS.—
8
‘‘(1) IN GENERAL.—Notwithstanding any other
9
provision of this section, no recovery or adjustment
10
may be made with respect to the estate of an indi-
11
vidual described in section 1902(a)(10)(A)(i)(VIII)
12
for medical assistance furnished under a State plan
13
(or waiver of such plan) under this title.

‘‘(2) COMPENSATION FOR PAST RECOVERY.—A
15
State shall provide for the repayment of any
16
amounts recovered or adjusted during the period be-
17
ginning on January 1, 2014, and ending on the date
18
of the enactment of this subsection from the estate
19
of an individual described in paragraph (1) for med-
20
ical assistance furnished under the State plan of
21
such State (or waiver of such plan).’’.
