WAIVER AUTHORITY FOR CERTAIN OVERPAYMENTS 1 OF PANDEMIC UNEMPLOYMENT ASSISTANCE. 2 (a) IN GENERAL.—Section 2102(d) of the CARES 3 Act (15 U.S.C. 9021(d)) is amended by adding at the end 4 the following: 5 ‘‘(4) WAIVER AUTHORITY.—In the case of indi- 6 viduals who have received amounts of Pandemic Un- 7 employment Assistance to which they were not enti- 8 tled, the State shall require such individuals to repay 9 such amounts to the State agency, except that the 10 State agency shall waive such repayment if it deter- 11 mines that— 12 ‘‘(A) the payment of such Pandemic Un- 13 employment Assistance was without fault on the 14 part of any such individual; and 15 ‘‘(B) such repayment would be contrary to 16 equity and good conscience.’’. 17 (b) EFFECTIVE DATE.—The amendments made by 18 this section shall take effect as if included in the enact- 19 ment of the CARES Act (Public Law 116–136). 20 Æ VerDate Sep 11 2014 04:21 Dec 02, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H8812.IH H8812 kjohnson on DSK79L0C42PROD with BILLS
