payment under such title for certain treatments for dialysis-related amy-
loidosis, and for other purposes.

Mr. BABIN introduced the following bill; which was referred to the Committee
on Energy and Commerce, and in addition to the Committee on Ways
and Means, for a period to be subsequently determined by the Speaker,
in each case for consideration of such provisions as fall within the juris-
diction of the committee concerned
A BILL
To amend title XVIII of the Social Security Act to provide
coverage and payment under such title for certain treat-
ments for dialysis-related amyloidosis, and for other pur-
poses.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Dialysis-Related Amy-
4
loidosis Treatment Act of 2020’’.

SEC. 2. COVERAGE AND PAYMENT FOR TREATMENTS FOR

DIALYSIS-RELATED
AMYLOIDOSIS
UNDER
2
THE MEDICARE PROGRAM.
3
(a) COVERAGE.—Section 1861(s)(2) of the Social Se-
4
curity Act (42 U.S.C. 1395x(s)(2)), is amended—
5
(1) in subparagraph (GG), by striking ‘‘and’’ at
6
the end;
7
(2) in subparagraph (HH), by striking the pe-
8
riod at the end and inserting ‘‘; and’’; and
9
(3) by adding at the end the following new sub-
10
paragraph:

‘‘(II) treatments for dialysis-related amyloidosis
12
(as defined in subsection (kkk)).’’.

(b) TREATMENTS FOR DIALYSIS-RELATED AMYLOI-
14
DOSIS DEFINED.—

(1) IN GENERAL.—Section 1861 of the Social
16
Security Act (42 U.S.C. 1395x), is amended by add-
17
ing at the end the following new subsection:

‘‘(kkk) TREATMENTS FOR DIALYSIS-RELATED AMY-
19
LOIDOSIS.—The term ‘treatments for dialysis-related amy-
20
loidosis’ means any item or service that is furnished in
21
a dialysis facility (freestanding or hospital-based) that is
22
approved by the Food and Drug Administration for the
23
treatment of dialysis-related amyloidosis, and any supplies
24
or services that are provided adjunct to and are necessary
25
for such treatment.’’.

(2) EXCLUSION FROM RENAL DIALYSIS SERV-

ICES.—Section 1881(b)(14)(B) of the Social Secu-
2
rity Act (42 U.S.C. 1395rr(b)(14)(B)) is amended
3
by inserting before the period at the end the fol-
4
lowing: ‘‘or ‘treatments for dialysis-related amyloi-
5
dosis’ (as defined in section 1861(kkk))’’.

(c) PAYMENT.—Section 1833(a)(1)(E) of the Social
7
Security Act (42 U.S.C. 1395l(a)(1)(E)) is amended by
8
inserting at the end the following: ‘‘except for treatments
9
for dialysis-related amyloidosis, which may not be included
10
as a renal dialysis service for purposes of payment under
11
any prospective payment amount or comprehensive fee es-
12
tablished under section 1881, and for which payment shall
13
be made separately in the amount of 100 percent of the
14
reasonable charges for such items and services,’’.
15
(d) EFFECTIVE DATE.—The amendments made by
16
this section shall take effect on the date of the enactment
17
of this Act.
