Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PPE FOR SCHOOLS. 1 (a) GRANTS TO STATES.— 2 (1) PROGRAM AUTHORIZED.— 3 (A) IN GENERAL.—The Secretary of Edu- 4 cation, in consultation with the Secretary of 5 Health and Human Services, shall make grants 6 in the amount described in subparagraph (A) to 7 each State educational agency with an approved 8 application. 9 (B) GRANT AMOUNTS.—The amount of 10 each grant under subparagraph (A) shall be al- 11 located by the Secretary to each State edu- 12 cational agency in the same proportion as the 13 State educational agency received under part A 14 of title I of the Elementary and Secondary 15 Education Act of 1965 (20 U.S.C. 6311 et 16 seq.) for the most recent fiscal year. 17 (2) APPLICATIONS.— 18 (A) APPLICATION REQUIREMENTS.—To re- 19 ceive a grant under this section, a State edu- 20 cational agency shall submit to the Secretary an 21 application at such time, in such manner, and 22 containing such information as the Secretary 23 may reasonably require. 24 (B) SECRETARIAL NOTIFICATIONS.— 25 VerDate Sep 11 2014 21:23 Nov 07, 2020 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8664.IH H8664 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 8664 IH (i) INVITING APPLICATIONS.—The 1 Secretary shall issue a notice inviting ap- 2 plications not later than 30 days after the 3 date of enactment of this Act. 4 (ii) APPROVAL OR DENIAL.—The Sec- 5 retary shall approve or deny an application 6 for a grant under this section not later 7 than 30 days after receipt of the applica- 8 tion. 9 (3) USES OF FUNDS.—A State educational that 10 receives a grant under this Act— 11 (A) shall use to not less than 98 percent 12 of the grant to award subgrants to local edu- 13 cational agencies in the State in proportion to 14 the amount of funds each such local educational 15 agency received under part A of title I of the 16 Elementary and Secondary Education Act of 17 1965 (20 U.S.C. 6311 et seq.) for the most re- 18 cent fiscal year; and 19 (B) may reserve up to 2 percent for ad- 20 ministrative costs and emergency needs with re- 21 spect to COVID–19, as determined by the State 22 educational agency. 23 (b) SUBGRANTS TO LOCAL EDUCATIONAL AGEN- 24 CIES.— 25 VerDate Sep 11 2014 21:23 Nov 07, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8664.IH H8664 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 8664 IH (1) APPLICATIONS.—To receive a subgrant 1 under this section, a local educational agency shall 2 submit an application to the appropriate State edu- 3 cational agency at such time, in such manner, and 4 containing such information as the State educational 5 agency may require. 6 (2) USES OF FUNDS.—A local educational agen- 7 cy that receives a subgrant under this section shall 8 use the subgrant for one or more of the following: 9 (A) Purchasing supplies to sanitize and 10 clean the facilities of, and the buses used by, 11 the elementary schools and secondary schools 12 served by such local educational agency. 13 (B) Purchasing personal protective equip- 14 ment for educators and other staff, and stu- 15 dents. 16 (C) Providing training on the use of the 17 equipment and supplies described in subpara- 18 graphs (A) and (B). 19 (D) Hiring additional support staff for the 20 cleaning and sanitization described in subpara- 21 graph (A). 22 (c) REPORTING.—Not later than 90 days after the 23 date of enactment of this Act, the Secretary shall submit 24 to the Committee on Health, Education, Labor, and Pen- 25 VerDate Sep 11 2014 21:23 Nov 07, 2020 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H8664.IH H8664 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 8664 IH sions of the Senate, the Committee on Appropriations of 1 the Senate, the Committee on Education and Labor of the 2 House of Representatives, and the Committee on Appro- 3 priations of the House of Representatives a report that 4 includes— 5 (1) the amount of each grant awarded under 6 this Act, and the State educational agency receiving 7 the grant; and 8 (2) the percentage of students benefitting from 9 funds awarded under this Act who are eligible for 10 free or reduced price lunch under the Richard B. 11 Russell National School Lunch Act (42 U.S.C. 1751 12 et seq.). 13 (d) FUNDING.—There is appropriated, out of 14 amounts in the Treasury not otherwise appropriated, 15 $17,000,000,000, to remain available through fiscal year 16 2021, to make grants under this section. 17 (e) DEFINITIONS.—In this Act, the terms ‘‘elemen- 18 tary school’’, ‘‘local educational agency’’, ‘‘secondary 19 school’’, ‘‘Secretary’’, ‘‘State’’, and ‘‘State educational 20 agency’’ have the meanings given the terms in section 21 8101 of the Elementary and Secondary Education Act of 22 1965 (20 U.S.C. 7801). 23 Æ VerDate Sep 11 2014 21:23 Nov 07, 2020 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H8664.IH H8664 pamtmann on DSKBC07HB2PROD with BILLS
